Good day everyone,
I want to first start by thanking you for taking the time to read my post and reply if you have insight. I am ready to pull my hair out!
I will give the short version here but would be happy to get into detail with anyone that thinks they can assist me further. I rec’d an approval letter (one paragraph) for an I601 in January 2008. This letter advised me that I would hear from the US Consulate in Montreal with further instructions. When that never happened, after several weeks I emailed Montreal inquiring. They replied saying that I need new medicals, prints, letters etc from my US fiancé.
The long and short is this…..I no longer plan to move to the US or to marry. The reasons are irrelevant to my inquiry here. I will not need the K1 visa. I have however met all that was needed to allow me to move and marry with respect to the I601. I have an American brother with family that I wish to see, as I haven’t been able to travel across the US border since November 2006 when I interviewed in Montreal and was told I needed the I601. Annually my family (excluding me since my interview) including my children travels for three days to the US. This annual trip is approaching in July and I would love to go! With the exception of applying and waiting another year and paying the fees all over again, does anyone know how I can cross the border and perhaps use proof that the I601 was indeed approved?
I have sent many emails to various email address at various levels of government in an attempt to reach a live person I can discuss my situation with. ALL of those emails have gone unanswered.
Can anyone help me please?

Sorry, karen, but I don't know for sure. My first thoguht would be that the waivers correspond to the actual visa you applied for. If you aren't going to use that visa, then the waiver can't be used for something else.

I thought that there was a waiver available for visitor visas, but these probably would take a while to apply for and get.

Oh wow. That is a tough question. I am pretty sure an I-601 waiver has no authority over a tourist visa. The reasons your waiver were approved were tied to your fiance, who is no longer in the picture I guess so it's sort moot. I'm not sure though.

I don't know if you have gotten any legal consult but you might want to do a consultation with one of the recommended attorneys on this site. I would normally suggest Laurel's free chat but you would have to wait until next Wednesday for that since it's canceled this week because of the AILA conference.
