I, Lupita submit this affidavit in support of a Waiver Application for my husband AEG because I would suffer extreme and exceptional hardship were my husbands waiver not granted. I am an American citizen born in Brooklyn, N.Y. USA on April 29, 1985 (Exhibit A)(my BC). A and I met in April 2001 when he was a gentleman for my sweet-sixteen (Exhibit B) (pics of us in sweet 16) we began a relationship and two years later on March 4, 2003 our first daughter Aimee was born (Exhibit C) (Aimee’s BC), she is now 5 years old. Over a year later in December 2004 A and I married (Exhibit D) (copy of marriage cert.) and on November 18, 2005 our second daughter Kaelah was born (Exhibit E) (kaelah’s BC), both are daughters are United States citizens born in Brooklyn, N.Y., USA. These past few months have been extremely difficult for myself and our two daughters, below I will outline issues including health, educational, and financial hardships I would face were my husband waiver not granted.
A has been in Mexico since June 2007, after being placed in backlog we had to make the hardest decision which was to part our family. I came back to New York with our oldest daughter Aimee because she was about to begin Pre-k (Exhibit F)(letter from Aimee‘s school), Kaelah remained in Chietla, Puebla with A. Unfortunately this decision almost cost Kaelah her life. When Kaelah was 9 months old A and I noticed one day that Kaelahs limbs would stiffen for no more than 5 seconds at a time, we took her to her doctor and she was diagnosed with febrile convulsions (Exhibit G)copy of Kaelah’s med record) (Exhibit H)(info on febrile convulsions). Five months into her stay in Mexico, a week before she turned two, she suffered a convulsion that lasted about five minutes. A was soothing her, he was about to put her to sleep when all of a sudden her limbs stiffened and her eyes rolled upward, she stooped breathing, her face turning blue, at the same time loosing conscience, her stomach swelled up and she began gagging. A immediately called me and began CPR, not knowing it was a convulsion. After five minutes she regained conscience and began breathing again. A took her to the nearest clinic where the doctors there told him that Kaelah had absolutely nothing, but if a convulsion were to reoccur, they would not have adequate equipment such as oxygen tanks to treat her, he was advised to take her to the nearest hospital in the next town Izucar de Matamoros, forty minutes away, which provided better staff and medical equipment to treat Kaelah. Here in New York both our daughters and I receive Medicaid and New York Presbyterian Community Health Plan (Exhibit I)(cpy of our insurance cards). To move to Mexico would be choosing to put Kaelahs life in danger and if a convulsion were to reoccur there would be little time and resources to try and get her breathing again.
When I arrived here in Brooklyn from Mexico I went to see an orthopedic because I was experiencing frequent pain in my right knee. I would feel tenderness if I touched my knee, after a while my foot would numb up. I was and still am unable to sit, stand or lay face down for too long, it’s even hard for me to kneel over a mattress. Dr. HMT; M.D., PLLC of NYM Hospital took x-rays of my knee and diagnosed me with Bursitis a condition where a bursa, a fluid-filled sac lying between tendon and skin, become inflamed (Exhibit J)(info on bursitis). Dr. T recommended physical/occupational therapy 2-3 times a week for a month (Exhibit K)(copy of recommendation). I never went to the therapy because I was providing not only for myself and Aimee but also for A and Kaelah in Mexico (Exhibit L)(copy of the money transfers). Being at the time the sole provider for our family I was unable to go to therapy, therefore there is still a possibility that my condition become chronic and there have been cases where surgery has been the only option to drain the bursa. Were my husband waiver denied we would put our daughters life at risk and we would not get adequate care in Chietla as we would here in Brooklyn.
I attended Bishop Ford Central Catholic High School from September 1999 to January 2003(Exhibit M)(transcript BFCCHS), I was about begin my senior year in 2002 when I discovered I was pregnant. I was granted early graduation, graduating in January instead of June, I graduated with a 90.409 overall GPA(Exhibit N)(letter from BFCCHS). Five months after giving birth to Aimee I began my freshman year at Hunter College (Exhibit O)(Hunter transcripts), after two years I took two semesters off to have Kaelah. Nine months after giving birth I reenrolled and after another two semesters of attendance, going into my junior year I had to put my education on hold. I have not declared my major; Psychology, because I was missing one class in order to be able to declare it, a class I was taking during the 2007 summer session (Exhibit P)(copy of summer session bill). I began the class but decided to drop it after the first day because A interview was within the days my class was in session. If I wouldn’t have disrupted my education I would be entering my senior year and graduating in June 2009. If A waiver were denied and I decided to pursue my education in Mexico I would have to put it on hold for another year because the deadline to submit the first set of documents ended May 30, 2007 and the deadline to submit the second set of documents including High School transcript, middle school transcript and a medical insurance payment are over July 11,2008 (Exhibit Q)(Requisites for foreign students). I would not have the time necessary to gather my documents and transcripts to register and begin school this year. If I transfer to a University in Mexico I would have to start my studies over which means the three years I have studied at Hunter College mean nothing in Mexico. I would have to take between 18 and 30 units a semester and would graduate in about five years. It would take me approximately 3 hours one-way to get from Chietla to Universidad de Las Americas in Cholula, Puebla (Exhibit R)(map of route from Chietla to Cholula) which is the closest University that offers a good Psychology program.
