View Full Version : I don't even know where to start. Please help :(

:cry:Where do I start? My husband is a native to honduras and I to the United States. My husband received a green card back in 1993 when he was 18 years old. We have been together off and on for 13 years and were recently married this year. When he was here in the united states he had gotten in toruble with law and he was given and option to serve 7 months in jail or sign a paper for deportion. During that time in his life he was not thinking of what effects of signing that paper would do to his future. He then later returned to the united states illegally he was here for several years then he was sent to jail and then deprted. He then returned again illegally after being out of the county for only several weeks. He remained here in the united states for about 4 years before he was deported again anf he has been out of the country for 4 years. I am trying to find out what steps i need to take to bring him back legally into the united states. I have heard of the I-601 form i don't know if that is for this situation and I am not sure what is the first step. Doi have to file for a visa first or together i am so confussed and i am trying to do this all on my own because i do not have money to support myself, help him, pay fees for the forms and for a lawyer. Any information on how i should start this process would be soooooooo greatly appreciated. thank you and god bless all who read this

Welcome TLC...I don't know exact law related to your sitation, so I don't want to guess and get your hopes up or crush them...Someone who does know will be able to help.

Also, it sounds like you have a complex case that might need the help of a good attorney.

Welcome to the site,you will find all the support you need here!~~wow you and hubby have been through a lot. I don't really know where you would start,but I would definitely consult with an attorney first!..Good Luck!

Oh yeah it has been alot. It seems so complex because of the re accuring deportation. I was looking into attorneys and alot of the ones i have found in my area do not deal with deportation cases.

Yeah from the day I met my husband that is when everything became complex. I thank God that my husband has changed his ways so much I just get this issue behind us. but i just have to figure out where to start and i don't want owaste money doing it the wrong way. Thanks for writting.

:wave: and :welcome:! Okay can you list his timeline, I know you wrote it out above but it will be easier, also with the dates. For example:

01/93 given green card
02/93 served jail time and removed
03/93 EWI
04/93 removed again

etc, etc. It is easier for us (well me at least) like that! :)

Can you give us the timeline? It seems like he might have a 9(c) ineligibility bar, but we really need you to give us the timeline, because the dates of his deportations are really important.

Also, what was his crime back in 1993 - drug related?

Ultimately, this sounds too complicated to not at least consult with an attorney. You should definitely consider a consultation with Laurel Scott, visacentral.net, or another attorney recommended in the Resources section of this forum.

I am sorry to have to tell you this, but with 3 deportations and illegal re-entries, I don't think that there is any way that he is going to be able to come to the US legally.

You definitely need to run this past Laurel, as I am not a lawyer.

Hi, I don't know how to say this but I do not think that he can get a visa. I don't think that he is eligible for a waiver either. Someone will come along with more info. Some others will post soon and let you know when and if he will be eligible to file the I-601 waiver. If he is then he would also need the I-212 for the deportations. And I am not sure what his charge falls under; CIMT? I have my fingers crossed for you!

He's most certainly not eligible to file a waiver, at least until he has been outside the U.S. for ten years, but maybe never, since he invoked a lifetime bar with no waiver already in 1999 when he re-entered, and then was deported again...

Also, possession of a stolen vehicle is not something they are going to look kindly on. It's good that it was so long ago, but just the entries and all the deportations make him unlikely to legally return to the U.S. ever.

Hello, My SIL has just been through this. He was deported on an Aggravated Assault charge and we went to see a lawyer. We were told that there is no chance of him ever coming back to the states legally. It seems that once you are given a green card, you get one chance. If you lose it for legal issues, that's it. The only chance is if either of his parents are a US Citizen. Does this apply?

I'm sorry and I know it's hard. But your happiness depends on your family unity, not on where you live. Get through the hard times and then you can figure it out. God bless you.

:ditto: This is really hard, but try to be strong and think of alternatives. My husband is also from Honduras and although I know life is not easy there, maybe relocating to another country would help. My husband has friends that are in a similar location and what they did was move to Mexico to start a new life there. Of course, Mexico doesn't have the best economy either, but it is sure a lot better than Honduras. Please try to stay strong and remember that your family is what is important and that no matter where you live in the world, as long as you all are together, that's what will make you truly happy, even if it is in Honduras or somewhere else.
