View Full Version : Expedite Request - When to Request

If you want to file a request for an expedite, can you file it at the same time that you hand in the I-601 and the HSL package or is this something that should be handed in later?

If you can submit at the interview when you hand in the package, do you let them know at that time that you are requesting an expedite?

It takes DHS approximately six months to issue a waiver decision. As soon as the Immigrant Visa Unit receives the decision from DHS, we will contact you immediately to continue processing the case.

I'm confused....I thought DHS didn't do the waivers anymore....they were giving them to consulate to do...

When I filed my waiver I asked the officer where it would be adjudicated. He told me that some get sent to DHS in Mexico City and some are adjudicated by DHS in Guatemala. Jenny, that confused me too!

Okay, I asked this question at my wifes interview.

DHS adjusticates the waiver. 90% of the waivers are done by DHS outside of Guatemala at some secret location in Mexico. The other 10% are done by the DHS office at the consulate.

All the waivers turned in at the consulate in Guatemala City are sent to DHS and take 6 months.

Now, as for an expedited case, I don't know about that but I was under the impression that to get one ...

A. the U.S. citizen must be dying (or some other type of dramatic event)
B. You will need to get your Congressman or Senator involved
C. most of us do not qualify for an expedited case

But I could be wrong. But for adjuticating the waiver, I was told by the vice counsul 6 months at the latest and that number was set in stone.

I think thats crap though! Mexico takes like less then a week!!! that is BS...

man, then I'm getting sue myrick on my side....I've done work for her in the past, and its time to call in some favors.....

I got two months left on my waiver. The vice consul did tell me that it was 6 months at the latest. It "could" be sooner but 6 months was the norm.

We were granted expedited service for the interview.. It was for July 30 and they changed to June 25th. I was told to send my request to GuatemalaIV @state.gov, I did this and they gave it to us based on our sons Chemotherapy treatment. At the interview my wife was denied her visa and we filed the I-601. I asked the man doing the interview if we would be given expedited service for the I-601 also. He replied "I don't know you will have to ask the DHS about that". I have sent 2 more e-mails to the same GuatemalaIV e-mail and they have yet to answer.

Is there any phone number or e-mail that is the best to check on this?

Previously, when I was told to send the e-mail asking for expedited service, the e-mail mentioned expediting of the I-601 is possible.

The problem I have with this is, you can't find information anywhere.

Maybe they are giving it to us, but we have no way of knowing because they haven't shared this information with us.

Well, I guess I am just wanting my wife home now, not later.

Usually it is best to get a Congressional/Senate Rep to write in support of your request to accompany your request. They usually have a special address to send it to. The CO should be able to tell you--after the waiver has been submitted to the appropriate office, possibly 2wks or more later, maybe same day--where it is being adjudicated.

As an aside, USCIS is part of DHS, and DHS/USCIS is often used interchangeably when it comes to waivers. . .this is why some decisions come marked, USCIS, some marked DHS and some, like mine are marked with both :dizzy:

Guatemala's six month wait is accurate. Our was turned in on February 26th, 2007, and my wife recieved a phone call from the embassy July 16th, 2007.

Guatemala does not have a faster process like Mexico. This is because the demand for VISA's from Guatemala is much, much smaller than Mexico.
