On the form DS 156, what I have to answer to the questions 22,26,27? And also to the question 29 and 38. My case is: 6 years ago I entered to an US airport with an fake passport. The INS officer realized this, so I recognized my true identity and I asked assylum. For this process I had to stay 3 month in a jail, but after 3 months when I met the judge I tolf him that I renounced to this process and I want to come back from where I came. So, after 5 days an officer accompanied my to the airplane and I came back from the last place I came US. In this case, what box or boxes I have to check to the question 38 and 29? Thanks.
I already have prepare my waiver packet and I have to go from an K3 interview.

The forms sometimes seem confusing particularly when one is worrying and stressing which often goes hand in hand with immigration. Take a deep breath and read the questions carefully.
Q22 It used to be the case that one could just put 'when visa is granted', but with the form now being online there is only scope for a date. It does however, also state in the question 'provide specific date if known'. I would take that to mean it only needs to be completed if the date is known. Remember, this form is used for other nonimmigrant visas. Ask yourself, do I know the date that I will be arriving in the US, which is what the question asks. If you don't know, leave it.
Q26 Ask yourself, how long am I going to be in the US. Remembering that this application is also used for other visa types. You are moving to the US 'Permanently', are you not. :)
Q27 Remember the purpose fo the K-3. To be able to travel to and remain in the US whilst waiting approval of the I-130 and to pursue permanent residency.
Q29 From what you are saying you were in the U.S. even if it was jail, so you would check 'yes', include the date of entry, and how long you were in the U.S. before leaving. And then include other dates of any earlier visits to the U.S.
Q38 The second one looks to fit your circumstances, but hopefully someone else will be able to confirm that.

Ausseiwench,thanks a lot. You have right. The stress really confuse me, I don't recognize my self. But I hope God will help me soon and everybody from this forum.
I really am in dilemma with the question 29, because I don't entered in US, just I entered on the airport. But I will put the answer you told me. Some persons tell me to put NEVER, because i will have DS 230 part 2 where I will have to check of the last questions with Yes or No ( about ineligibilities). Other persons tell me to put NEVER but to add a Note and to explain what happened. Really hard. Thanks again,you really help me. Have a good day and God bless you.

Aussiewench, not sure about this, and correct me if I am wrong, but Q.29, if she was held at POE she didn't actually enter US, although this is a little confusing as she spent time in Jail, I was wondering if she should attach a note explaining this.

I was in two minds with that issue as well. Wondering if perhaps Dana could pose that question to Laurel in chat, to clear up any confusion.
My thoughts have always been, better to include something, rather than not. If it isn't deemed an entry by the conof then no harm done as it would be ignored. If not included, it may be seen as withholding info. Can't attach notes to an online form.
Dana, ask Laurel in chat, to see what she has to say on the matter. I would hate to steer you wrong on this.
