My wife has a ten year ban and has got 6 years left.
The first waiver was denied.
I want to refile so my question is.
Do i refile another waiver or do the whole damn I130 again.
My attorney tells me that we do not have to refile another I130 because the I1130 was not the application that was denied.(it was the Waiver) She says that the I130 will always be alive. and we have to file another waiver..
How the hell will she file another waiver through London ?
What do i do ?

yeap members in this forum who are denied abroad do re-file waivers all the time.

I believe that you have to write to the consulate requesting a new appointment. Hopefully someone who has done this will be by shortly with details. :blush:

I am sorry to hear that you waiver was denied.
You do not need to re-file I-130 ( as soon as approved, this form does not have an expiration date).
I would suggest you ( or your attorney) to contact your consulate and ask them what procedure do you need to follow. You will definitely need to pay waiver fees again. I am not sure do you need to have another visa appointment.
When we were going throw the waiver process, one attorney told us: they may deny you once, may even twice, if you would keep trying – they would eventually approve you.

I don't think you need I-130 again,this form does not have an expiration date..

Blackrain76, You can refile your waiver. You will have to call the consulate office where you filed the first time. Ask them for a appointment day to refile your waivers. I've done this twice and it works in the consulate office in Albania. You have a Attorney so it mit be better to have her call to set it up. Good luck
