10 year ban

My wife has 6 years left on her 1o year ban
my first hardship waiver was denied so i am about to refile.

Do i need to refile or do i just file another waiver ?.

My attorney tells me that if my i130 was approved the first time we do not have to refile the I130 because the i130 was not denieD. The waiver was denied so we only have to file a waiver.

My question is how the hell will she get through to London and refile the Waiver again.

So she's been in her country for 4 years? I think there's some confusion about whether or not the I130 is still valid after a denial. I think once the 10 years have passed you would have to refile the I130 again and I don't believe you have to do the wavier again but you would still have to prove your case.
