View Full Version : 28 Months & Still counting in Islamabad Hell!

Neverending

I just saw the post on CIS closing in Islamabad. Good riddens. They don't do crap there anyway. We are now waiting 28 months and counting for our 601 and 212 waivers!! No end in sight. NONE.Background checks, background checks, like a broken record!! Ive contacted everyone under the sun who could possibly help and its useless.

Recently another person waiting 2 years was just denied. Absolutely incomprehensible. They said she created her own hardship by going there. How can they say this? I know of other cases where the spouse went and married in the foreign country and many were approved. How is it that the same standards and guidelines are not followed for everyone? I don't get it. Her attorney is filing an appeal saying that they have made it impossible for anyone to meet the hardship standards/guidelines in Pakistan; that nobody would be able to meet the guidelines if her hardship is not approved. They said because her husband has a hx of misrepresentation. That's why they filed the waivers!! No he did not impersonate a US citizen either.

I guess Im just waiting for our denial letter also. Rome has more denials than approvals I have noticed when I compare the lists over the past months. Seems they are purposely denying cases so they can make more money on the increased fees for refiling appeals, etc. I never dreamed we'd be waiting 2 1/2 years with no end in sight. Is anyone else waiting this long for waivers anywhere????!! I dont think so. Im so mentally and physically exhausted I can't go on much longer. Its an endless losing battle. This is a living nightmare!

We're also waiting... your case is in Rome, correct? Why hasn't it been processed in the 6 months it says it would take...

I'm sorry Never...no one should have to endure such an excruciating ridiculous wait. That isnt fair at all. I hope you get a favorable answer soon! I know this might be a stupid question but is there a way your spouse could move somewhere else? Maybe try that route..but I am sure you guys have thought of all the possibilities. :o

Neverending, I just wanted to say how sorry I am that you have had to wait 28 months for an answer. That is inhumane...

my heart goes out to you as well
that is just a ridiculous amount of time to have to wait
and worse, its for a discretionary decision, after all the due process
but dont give up hope, and keep fighting your not alone
my waivers are currently in bangkok and my wife and I have been seperated almost a year now
to go thru all the process and then have to wait for a decision that could take years is inhumane
and they say that its all about family unity...what a joke
Ive said it before in other posts...perhaps some of these adjudicators should be made to live without their loved ones for extended periods of time...and then be denied the right to have them back..

OMGoodness Neverending......I truly can't imagine how far, 28 months of waiting has pushed you or anyone for that matter. You did mention you had tried everything so you may of already tried this...but did you try to get the USC's congressman or senator involved ? You may of tried this by month 15...but I thought I mention it in case.
God speed Never.. where-ever the case is heard...but don't give up!

I just want to thank everyone for all your emotional support and well wishes. Everyone has been great here through the years. If it weren't for this forum there would really be nowhere to turn when dealing with this. It's not like many people at work or anywhere else you go have this kind of problem, if you know what I mean.
To answer some of the questions, yes I contacted all the govt officials, etc to no avail. It only took John Bulgar in Rome (guy in charge over there) EIGHT MONTHS yes 8 months to actually reply to my congressmans letter. (Direct reply from HIM, not the regular generic reply, although it was the same anyway.) I received a copy with all the dates on it. I couldn't beleive it took this long but now nothing they do surprises me. I have now contacted the Ombudsman. I have heard they really do nothing either but they were the only ones I did not contact. There is nowhere else my husband can go to where we could live. All Rome does is tell me that sometimes this process of background checks can take years. I said, it's been years, idiots!
If we are denied, I can't go another 2 years waiting for an answer on an appeal, etc. My husband has less than 5 years remaining on his bar and I think at this rate that will come before anything else does. My advice to anyone dealing with Islamabad and waivers is if your not mentally ill now you will be by the time you're done with their process and stay away from them if at all possible! If youre from any Muslim country and filing waivers, you're pretty much doomed it seems.
