question for BIL

My mother in law petition one of his sons that was born in mexico. back in 1992, MIL became USC in june to adjust BIL papers faster, well BIL decide to get married and put Wife in the AOS application. she received the work permit in july. The went to the interview and they told him that they had to wait because there wer eno visas avalilable. well last month he requested another interview. He went and they told him that they were waiting for the results of the FBI. but it's been over a year now

so then he talked to a lawyer because he was getting worried about his case, and the lawyer told him that he had a deportation. and that that can complecate his case. well he wants has an appointment with that lawyer, and he want to know if he should go or not, he recently received his new work permit, and his wife just applied for another one

any advaice is greatly appreciated. thank you

he is despered for some aswers!!!

Has he completed his own finger print request from the FBI? Many people do those to make sure that their SO does not have a deportation. Does he have a common name, which could have confused him w/ someone else based on the name check?

his name ishis last name is morales, but see the thing is that he tried to cross the border back in 2000 and got cought, but he didnt sing his deportation...insted he wanted to speak to a judge, so he did, and since he never sing that, the laywer is saying that, by him never singning the voluntary departure paper, it became a deportation automaticly....im sorry do i make sence...lol his case is allittle complecated.

Oh I see...hmmm. Does he have any sort of legal documentation? Do they even give out documentation for deportation? I would do a FBI check (http://www.fbi.gov/hq/cjisd/fprequest.htm).

yeh that is what i was telling him, no he dosen't have anything....he never knew he had a deportation on his record until he talked to that lawyer.......but what is funny is that he has been getting work permits one after the other.

Yeah...that is why I wondered if there was a hit on his name do to it being common and perhaps he is being confused. I dont know what else to recommend but to do the FBI print, hopefully that will bring some sort of an answer. You know what...could he request the result from his lawyer stating that he has that in his record?

im glad you mention that, because that is exsactly what i told him, i told him to have the lawyer shou him something that states his deportation or what ever he is saying is on his record...the funny thing is that the lawyer told him this just by his name a date of birth....
