As I explained on another thread I can no longer find, My husband was denied last Thursday. Well I called Mr. B this morning was very nice he looked at the case and said let me transfer you to someone who can help you. We talked for awhile and I explained the whole situation with things wrong on my husband's record and the interviewer wouldn't even look at the certified court documents etc. Which were mailed to the NVC. So I was told to write a letter explaining everything, send a copy of the visa denial, send copies of court records and send the letter from the probation office. I'm mailing hard copies to El Paso, TX and faxing them as well. She stated that there will be either a new decision mailed, new interview set up or everything will stay the same. At least we get a chance to correct their mistakes. Before I hung up I asked the person's name as she stated that she could not give that to me. But she specifically told me to put Team 5 on my letter for the Visa Section. I'm just hoping something will be done. I thought I would let everyone know what I found out.

My husband was denied his Visa last Thursday on the INS Moral turpitude, controlled substance, and overstaying from previous immigration issue. This is all incorrect and we have all the certified documents to prove this. Moral turpitude problem he had retail fraud 3rd degree (less than a year probation) the law states this is a problem if it is more than 6 or 12 months inprisonment. He was only given a ticket never arrested. Even got a letter from the probation office. Next issue is controlled substance : he was arrested for less than 25 grams of a narcotic which was in his vehicle not his. The case was dismissed, closed and all charges dropped within 10 days of the arrest. Have all court documents certifying this issue. Third thing they said he never left on a previous immigration order etc. He only got Voluntary departure this year and left with safeguards. That is another problem. So I wrote a letter explaining all the issues and sent copies of all court documents again. So hopefully this helps.

I also emailed President Bush, VP Chenney, US Attorney General, Senators Stabenow and Levin (MI) and Presidential hopefuls Obama and McCain. Hopefully I will get somewhere with this. I'm surely not sitting back and waiting.

His visa would have been denied no matter what, because of unlawful presence. Did you figure out if he is eligible for the waiver as it stands right now?

As of right now I don't think he is elgible for the waiver. I'm mailing the documents they requested today to them. I'm also waiting for the attorney that was going to do the I-601 Waiver for us to see what our options are. They have incorrect information that needs to be corrected. I will let you know what I find out.

Gotcha. Then it sounds like you are absolutely doing everything you can. I would suggest your attorney consult with Laurel. It's free for a lawyer to consult with her and she might be able to give some additional tips as it seemed he was unprepared for this possibility.

I don't think it has sunk in quite hard yet. I have to stay strong for my three beautiful daughters. I have all this to deal with immigration and the fact my ex husband who hasn't seen his two daughters in three years is trying to see them. Too much all at once. I guess this is where my paralegal degree that I really don't use comes into play. I already mailed the packet to El Paso today.

Regardless if/when we hear something it looks like we are going to be going on a road trip in July to see husband and so the kids can see their daddy. Cost too much to fly wit (4 people). I think we are going to go to the Texas/Mexico border by Brownsville. That is the closest place to drive in Mexico from Michigan that has a beach!

This is intense but I'm seriously impressed by how organized and informed you are. I wish I'd been more prepared but it sounds like you've got what you need to resolve this. I hope all goes well and you hear back soon!

The latest update Senator Stabenow office just contacted me. They are going to be sending a form for me to sign so they can discuss my husband's case with me and maybe step in if Juarez doesn't do anything. I've actually had a couple of converstaions with them in the last year. So I'm just hopeful something gets done.

PS. I had chinese for lunch and my fortune said this: An unexpected event will soon bring you fortune!

I got a call back from the court today inregards to the issue with the controlled substance. They don't know what immigration is looking at but it clearly shows the arrest date and then 10 days later the Judge dropped all charges and closed the case. Hopefully once someone at Juarez looks at the documents that I orignially sent which is the certified court documents that will chance their decision. I'm staying strong and continuing to get all doctor letters/evidence etc. for my HSL.

I will let you know more when I hear something!

Today when I got home their was two letters in my mailbox. One from Senator Levin's Office and the other from Senator Stabenow's Office wanting information from me so they can help me with my husband's case. It's not much but it is a start! I thought I would give you an update.
