Well I had told the secratary (Laywer's) to please reopen my case with NVC since December 2007, he said he did and that he had an email from them that they were working on my case, well he also said he was going to send it to me and nothing, I also asked him if he needed to change my address since I have moved twice since I filed my case in 2003. He said it wasn't a problem since I have them and they recieve notifications too. I had called the NVC in summer2007 out of desperation and I was asked if I still lived at the original address, I wasn't going to lie to them so I changed my address. Its almost been 1 yr since I moved from that address and I went online to BCIS and it says you have to make notice of change of address within 10 days. Will I have a problem with them if I decide to change it now? B/c I want to recieve notification if I get an appt to CDJ since the lawyer never calls me. Besides my troubles My cousin Diego863 got her approval and is on her way back from CDJ!!!!!! She had been gone for 6months, I'm glad she was approved and is coming back!
PLEASE HELP

If you are able to go see your attorney in person, I would strongly advise that you go do that to get this situation straightened out.

If you have a lawyer, you wont' received a notice, only the attorney does, I have an attorney and they received everything from NVC. I do get a copy from them. you can call them again and tell them that you have changed it. I don't think you will get in trouble.

Adri...first of all, congrats to your cousin! That is wonderful news! I would make sure NVC has your correct address..They sometimes mess it up even when you correct it with them. I don't think there will be any issue with you changing it now..

I would call the NVC yourself and see what your current status is. If you have your case no, there is an automated system that will give you the status. Talk to an operator and make sure they have the correct address on file. You can also find out if they sent paperwork to your lawyer that needs to be filled out.
Congrats to your cousin Diego! I am extra interested, b/c we had our 1st appointments on the same day (Dec. 14, 2007). Did your cousin expedite her waiver b/c of a medical issue or something? She got approved so quickly! I wonder if I should start to get excited...please please please fill us backloggers in, a december approval would be HUGE NEWS!

adri, you can actually email the NVC with a re-open case letter also mail it out, I did it myself my I-130 was approved in 2005 and I reopened the case early this year this is the example letter that I sent:
Name
Address
Date
National Visa Center
32 Rochester Ave.
Portsmouth, NH 03801-2909
RE: Request to re-open case
Case Number: xxxxxxxxxxxx
USCIS #: xxxxxxxxxx
Petitioner: NAME
Beneficiary: NAME
Priority Date: XXXXXXX
To Whom It May Concern:
On (date that I stopped the process) I sent you a written request stating that I was not going to file for an Immigrant Visa because I was going to apply for adjustment here in the United States and because of this I did not send the Immigrant Visa Application Processing Fee Bill.
I am hereby making a request that you re-open my case, XXXXXXXX, immediately.
I ask that you please re send the Immigrant Visa Application Processing Fee Bill and any other paperwork that you should need me to file. I greatly appreciate your cooperation to this matter.
I thank you again for your time and consideration.
Please mail the information to:
NAME
ADDRESS
Sincerely,
NAME
Don't worry, you're not going to get in trouble for not changing your address within the 10 day period. I'd just call them and update it and find out what's going on with your case.

The reason she had been backlogged was b/c her husband was delivered by a midwife, (her mother in law had to bring info and prove it was a real birth), she had an appt in march for her visa and she thought she didn't need an I-601 b/c they had told her husband to just come back and they would have a visa (I told her she did need to make an appt for the waiver but she went ahead and went without one :nono:) so they went for their appt and were told to come June11 for the waiver and she was approved Visa in hand June12. She also went ahead and got a lawyer b/c she didn't have enough info for her waiver. I'll have to tell her to get on so she can do her I-601 experience by the way her lawyer used the letter I had helped her write from the beginning :smirk: she just reworded it a little. I told her to have her lawyer email it to me so maybe I'll put it on approved letters forum.

Thanks for explaining...so she was approved same day through the pilot program...it just took 6 months from when she returned to Mexico until she could actually submit her waiver, right?
