Hello All,

I am in process of filing an Application for Waiver of Grounds of Inadmissibility - due to misreprentation. I reside in Delhi and my husband is in USA. He is going to be US citizen soon and will be filing I-130 and I-601 at the same time.

I want to know any good lawyer who can help us out. Someone who have experience in dealing with cases from India.

There are many member here from India and I would request them to share their experience and the lawyer they consulted (if any).

Welcome to the site. First of all, your husband has to file the I-130 FIRST, he will indicate that you are overseas and want to do consular processing, once your case is complete it will go through the National Visa Center. They will schedule an interview for you in Delhi, at which point they will deny your visa due to the misrepresentation and then you will be able to file the waiver. The I-601 cannot be filed until you are denied your visa at the interview. The only exception to this is if you are still in the U.S. But in-country waivers are very hard to get approved anyways. This process can be very long. I would file the I-130 as soon as you can, as the processing can take anywhere from 4 months to 9 months. The waiver can take 6 months to a year. I am sorry that I cannot help with the name of a good lawyer (I did the work myself with the support of I2US). But I did go through a very similar process to the one you are going to follow - I will help if I can.
I applied for US Citizenship over two years ago (swore oath Feb07), and my wife has just (Jun08) received her visa after her waiver (overstay) was approved in Bangkok. This process does take a lot of time!

I agree with Lauren about the steps. US Immigration is a process controlled by bureaucrats - and even though I could tell you what each step is, and even though you know the answers, they will force you:nono: -frustratingly - to make only one step at a time and sometimes to wait for the most amazing non-reasons:bang:.

you should call "michael phulwani"...i may have spelled his name wrong..just google it. He is the top lawyer...has an office in Mumbai and in New York. He is pricy but a damn good lawyer...he is worth your money.

You can work with any attorney that specializes in immigration, it does not have to be someone specifically in India, and there are some really good specialists that aren't too high priced. It's a good idea to talk to more than one.

You can only file one application set at a time. Like they say, first the I-130, then after time at the NVC you will be given an interview. At the consular interview is where you can file the 601.

I also agree that any lawyer specialize in immigration is good but with my bad experience, I'd prefer to get a someone with more experience and knowledge...and I know those two qualities comes with a nice price as well :D. But Seema, just to let you know, after I got screwed with my lawyer in NY, I came to this website, read TONS of example hardships letters and prepared my husband's package myself. I thank each and everyone on this website for sharing their info. :cheerful: Now our case is in New Delhi since march 08...and it's getting closer to 6 months so we all are just praying...for my hubby to come to U.S.A
