ok, i have already posted the original hsl that need further review, please any ideas if you think this is better and what else i should summit.
Dear Sir or Madam,
I am sending this letter to support my original hardship letter that was submitted on May 19, 2008 for my wife but needed further review for lack of evidence. As I stated in the original letter I have relocated to Juarez, Mexico from Albuquerque, NM in order to be with my wife. I did this because I love and need xxxxx in my life; I need her with me each and everyday. I have been so excited thinking about being able to live in my country, the country that I served and love with my wife and I can finally make our dreams become true. When xxxxx finished her appointment and told be that it was not approved I was devastated, I have been living an extreme hardship for the past 2 years and it is taking a major toll on my life. xxxx and I was married on April 20, 2006 and at that time I was still living and working in Albuquerque but was traveling to Juarez to spend the weekends together. Leaving my wife and driving back was very hard on me, I hated the fact that I would not be able to see her again until the following weekend. It became too stressful and was tearing me up emotionally not being able to spend everyday with xxxxx, we got married because we loved each other and wanted to spend our lives together. I decided that we needed live in Juarez together and I would work in El Paso until xxxxx was granted residency, if that was what I had to happen in order for us to be able to live our lives together. I do not understand how a marriage based on love and desires to be together can be successful if they can not live their lives together. I have been living my life with my wife for the past 2 years, I have waited outside during xxxxx appointments at the US Consulate and I have always been by her side when she needed me. Our love and desire to be together is strong, but living in Juarez is changing me as a person. I have done everything possible to improve our situation from relocating to be with my wife to starting a business to improve our financial problems. I will not be able to continue living my life in Juarez and moving to the home town of my wife is not an option and I must live in the United States for the following reasons
I- Fear
We have been living our lives in Juarez so that we can be together but due to all of the recent ongoing violence (EX #1) we can not continue living in Juarez. There has been close to 400 homicides (EX #8) since January, I fear for my safety, the safety of my wife and her son. I can not live my life in fear because of the city I am living in; they have stolen one of my cars I will not wait until they take one of our lives. With all of the violence continuing living our lives in Juarez is not an option.
II- Disabled veteran/need for ongoing medical attention
If I relocated to my wife’s home town of Cuauhtémoc I would not be able to receive the medical attention that I require as a disabled veteran (EX #2). As a service related disabled veteran I am in need of on going doctor appointments, these services are free to me at any VA clinic in the US. Since living our lives in Juarez is not possible due to the violence it only leaves two options, moving to my wife’s home town of Cuauhtémoc where there are no VA clinics and I would be forced to pay for my health care and would not be able to afford it. Or I would have to live my life in the United States separated from my wife so I can continue to receive the medical attention that I require as a disabled veteran for no charge. Also as a disabled veteran there are many other benefits that I would not be able to use such as prescription insurance and dental insurance. My disability claim is going to be reevaluated due my condition getting worse.
III- My visitation rights with my children
I have legal visitation rights with my children and with the situation of me living in Mexico I am loosing my rights (EX #3). Since I have been living in Juarez I have been loosing my visitation rights with my children and if I move to my wife’s home town it will continue. This is another reason why I must live my life in the United States, my children need me involved in their lives. The US Department of Education has done statistical analysis titled Fathers´ Involvement in Their Children’s Schools (EX #9) that shows the involvement of fathers in their children’s schools appears to important for children. When a father is not involved in his children lives it has a negative effect (EX #10), I can not be involved in my children’s lives living in Mexico.
IV- Financial losses
Since I have relocated to be with my wife I have taken a large cut in pay (EX #4) and not living in the US is making it hard to recoup the losses and pay my bills (EX #5). I recently started a business based in El Paso, TX as a way for me to improve my financial situation, but I must live in El Paso for my business to be successful. With my current situation of living in Juarez I am losing over 2 hours a day commuting from my house to my business, that is 12 hours a week that can be dedicated to marketing my business which would generate more jobs and money.
V- Loss of Business if I follow my wife to her hometown
I am a small business owner (EX #6) and if I followed my wife to her home town of Cuauhtémoc I would not be able to continue my business. I am the owner of a carpet and upholstery cleaning business, my business is located in El Paso, TX. There is no way possible that I would be able to run my business while living in my wives home town, even if I moved my business there my lack of Spanish and the cities economic situation would not allow it to be successful. The business is improving greatly, with El Paso having Ft Bliss and my veteran status I have been successfully marketing thru the military. My business is the way that I can provide for my wife and my children, but I am losing out on jobs because I can not have my work van readily available for me to respond quickly in emergency situations. Not only can the business be our financial stability if I am allowed to live in El Paso with my wife and can put the time and attention the business needs but as the business grows it will provide jobs to the El Paso community.
VI- Parents of wife are legal permanent residence
xxxxxx parents are legal perniment residence (EX #7) and live in Arizona, her father xxxxx is 72 and her mother xxxxx is 68. Because of her parent’s age and their diabetes (EX #11) traveling is very difficult for them; if xxxxx is not granted an immigration visa she may not be able to see them again. My wives parents plan on relocating to El Paso from Peoria, AZ if xxxxx is granted residency so that she can help take care of them as are growing older (EX #12).
