Hello everybody.
I'm happy to "join the club". It is nice and very sad at the same time to see that so many people are in a similar to my situation. My hubby got deported in May 2007 to Belarus for overstaying his J-1. We have two small children together. After he got arrested I filed I-130 and I-129, got them both approved, now we're waiting for his interview on July 7 in Warshaw Poland, where he also going to drop off I-601 and I-212. I was wondering if anybody did there waivers trough Poland? How did it go? How long did it take?
Thank you all.

Hi, I am going to do the waiver thing at Warsaw. I am waiting for my case at NVC to be complete and the interview scheduled. As I understood from this forums the waivers filed in warsaw would go to Vienna consulate and it takes about 6 months to get a decision.

I wish you Good Luck!!!

Yes, you will file waiver in Warsaw and they will forward it to Vienna. Vienna is not eazy (3 waivers in 5) but if you put together good HSL you have good chances. It takes 6 months. I'm currently awaiting waiver approval in Poland, fell free to pm me with any questions!!!Are yo useing lawyer???whats your main hardships??
Good luck!

We went thru Poland. It was 2005 but I can say that overall it was an OK experience.

We went to the visa appointment (you can join your husband if you want, and will be permitted to the Embassy). We were called to the window, asked questions (similar as I-130: where did you meet, when did you marry,….) then told that everything is good BUT since I was unlawfully present in the US they can not issue me a visa and I have to submit a waiver.

We told an officer that we have all papers with us, paid money, got fingerprinted, had to convince consular worker (not a consular, just a clerk) that we insist to give them all hardship documents with our waiver not just some ( we had more then 2 inches file), were told that tomorrow waiver will go to Vienna ( a lie), that it should take about 2-3 weeks to adjust ( a lie, on that time it was 9-12 months waiting time) and we left the embassy.

It took 1 month for our wavier to be transferred to Vienna. Then in set there for 9 months ( there were no adjudicator there on that time), and it was transferred to Frankfurt where it was approved in 2 month.

I have heard that it is faster in Vienna now, about 6 month.

Good luck.
