H1-B visa and VWP

Hi ALL;

If one was to go to the states to visit family on the VWP and a family friend who owns a company offered him or her a job there (H1-B) visa,.

can the person accept this job offer?

No, change of status is not allowed under the VWP program. You cannot obtain a workpermit, you will have to go back home and go through the H1-b process.

actually H1-B can be done there, it does not have to be done overseas, sorry cause my friend just did it!heheh
The fact is she was not looking for work, and the company owned by a family friend needed to employ someone ASAP for his IT department and fitted the bill, on VWP you cannot work but she was OFFERED the job she was not looking or applying for jobs, the company director filled out the forms and obtained a H1-B visa for her WHILST she was still in the country for 90 days..so yea
