Hi all, a friend I met in another forum is getting very stressed out and worried, so she asked me to post on here, so here goes.
She is a canadian with a young son, she came to the US in Dec 2006, got a stamp in her passport at POE, (no I-94). she came here visiting friends and relatives, the friend she was visiting proposed to her over christmas, they married in March 2007, she stayed in the US and filed the AOS package late July 2007, she is now stressing out and worried incase she gets denied.
She is wondering if she can cancel the AOS file already sent, go back to Canada and filing K3. can she do this or will there be repercussions as she has already "started the ball rolling" ?
will she have a ban for the overstay?
If the stamp in passport is valid for 3 months then she has only occured overstay from 19th March to date or when she filed etc.
Her son is attending school here, is that illegal?
