Hello....I just wanted to introduce myself, I am a Peruvian-born US Citizen. My wife is from El Salvador and she's waiting for the waiver decision. I was told by the embassy to wait 6-8 months after DHS receives the waiver, anybody knows of other case's timelines?

God Bless everyone:

Mike

Welcome. My husband is from El Salvador as well but right now we are waiting on our interview for the Visa. There is a person on here that is also waiting on her husbands waiver approval and that is Paige. She turned her husbands waiver in November and it was received at DHS in Jan. 08
Good luck with it I hope you here something soon.

Hi Mike, great to see someone else from El Salvador. We are few on here. Yes, as luisymary said and as you can see from my timeline, we are currently waiting for our waiver approval. The embassy told us 6 to 8 months, but they didn't say anything about how that related to when DHS received the waiver. Lately, when I call the 202 number to check on the waiver, they tell me that DHS is now saying 6 to 12 months from the time they receive the waiver.

Did your baby go with your wife? Have you been to see them? It is pretty hard to be separated especially when children are involved I think. My husband has been over there for a little over 1 1/2 years now. We have a daughter who will turn 3 in July and we are expecting a new baby in July. We have gone to visit my husband every 3 to 4 months since he left. It is hard sometimes to see what plan God could have in this process since it is taking so long, but we are trusting that He knows best.

I wish you well, and welcome.

LuisyMary, Paige, MP Thank you and well it's too bad there are not many cases to have an idea of where they are with respect to El Salvador waivers, but hopefully this page we'll be a footprint for others to have faith and hope. That's how it all started for me and my wife, she did not want to go, but i said "let's do the right thing"..estamos cansados de tener miedo de que algo le pase cuando maneje, i couldn't stop worrying about immigration raids and that one day i would come home and not find her, and that all the fear tha's causing in our hispanic neighborhood, but you know what, we trust in the Lord, the Lord we'll provide, and if it helps someone down the road to be courageous and valiente to make the decision to do their waiver, so let it be.
My wife has my little baby girl, she's going to be 10 months and i am planning to celebrate her 1 year birthday over there in El Salvador. Small nice country i would say, even though i have very few relatives in Peru, almost everyone is here in the US, we are all sons and daugthers of Jesus Christ, we do not need the papeles of christian citizen, the word says come to me all of you in need because it's only though me to find salvation. So do not be feel bad, our citizzenship is in heaven with GOD.

¡Hola! Welcome to I2US. I'm thrilled to see someone else going through El Salvador and who is a Believer in Christ! We are few on this forum like Paige said, but we stick together! :D My husband will probably go back for his interview sometime later this year. We are getting ready to send off the DS-230 packet and then we will go from there. What part of El Salvador is your wife from? My husband is from Sonsonate! ;) I wish you both well, a SPEEDY APPROVAL, and may God grant you peace and comfort during this time.

My boyfriend is from El Salvador, he EWI'd in 2003. We have been together for about a year and although we've discussed the future, I'm still going through a divorce (it's been long and drawn out) so I can't do anything but sit here and wait and hope. His mom is coming into town next week and it'll be the first time he seen her since he came here. I'm quite nervous to meet her because I don't speak spanish and she doesn't speak english.

I wish you all the best of luck going through the process...one day I hope to be able to finally start it :)

Thank you mormita, that link has some very good info, there's just so many sites nowadays, that you don't know where to go. My wife lives in a small village between San Vicente and San miguel. It's about a 2 hour trip from the airport. It'll be a good idea if some can filter, from the Univision site, out the approvals/denials from El salavador and post it here. idon't have an id in univision, i rarely used because of time.

LuisyMary, i do recall paying close to 300-350 in medical fees, it added it up because my wife did not have proof of her vacinnations, but if you do have proofs, you'll save yourself a good amount. My wife needed the passport and the letter from immigration which indicates the embassy case number, it's the one telling you that your husband is ready from medecial examination. If you don't have this paper, they won't accept you in the medical office. When i was there Last novemeber, i saw a case where a lady did not know that she had to bring it, therefore she was not seen by the doctor. I forgot the name of the doctor we went, but it was a high class area, pretty nice and a lot of military, so the area is safe in the day. The appointment was quick, well, sort of, about 2.5 hours, because my wife had to get ALL her vacinnations.

I'm in fairyofgrace's situation, my bf EWI'ed in 2003 and we have been together for over a year now and will be getting married in the next few months. I have not started the process, but the part I am mostly worried about is him going back to ES to wait for the interview and submit his waiver.

At what point should he go back? Can he go right before the interview?

Tropical88,
Back in October when i wanted to call for an appointment with the US embassy in El Salvador, they would not allowed us to make the appoinment until my wife had taken the medical examination and they said the examination can only take place with the list of approved doctors, which they include with the letter stating your case is ready for interview. My lawyer was shocked because last summer her last El Salvador case, the client didn't do the examination until few days before the interview. I guess the embassy changed the process, Although luisymary seems to be different. I am not sure why. So my wife had to travel to El Salvador for the test, and then we were able to get an appoinment, but just to get an appoinment was difficult, because some days they were closed (tahnskgiving holiday and christmas) and sometimes they didn't have available appointments.

Just from reading around on different forums I've also seen that some ppl are required to get police records from El Salvador even if they have not been there in over 2 years since their interview will be in El Salvador, so this would have to be done before the appointment also. So this would mea he would have to go to ES around the time NVC starts requesting information so we can provide that to them?

Tropical, my husband went to the nearest Salvadoran Consulate here in the U.S. which happens to be in Chicago for us, and he obtained his police record at no charge, but they move like molasses. :waiting: I believe it took about two months of waiting for his police certificate to be sent to our address directly from El Salvador. I found this website that has the nearest Salvadoran Consulate in New Jersey http://www.elsalvador.org/embajadas/eeuu/home.nsf/infoconsular. Here is the contact info. for this Consulate:

Okay, a few things.

luisymary- How do you know that your interview will be in July or August? I just don't want your hubby to go prematurely.

Mike77-We also had to wait for packet 4 which had all the instructions for the medical exam and what we had to collect before we called to schedule the interview. However, the letter said to call the VIC within 2 weeks. We rushed to get everything ready, then called and called and they kept saying to call back next month. Finally one day a letter came in the mail saying the date of the interview. We never did schedule it with the VIC. Was that your experience?

tropical88-My hubby was able to get the police clearance (Solvencia de la Policia) very easily because he was in El Salvador, but I am wondering whether a family member from El Salvador would be able to request it also. It would be worth a try. There is some document, I can't remember which one, that is only good for 60 days I think, so you don't want to get it too soon. That might be the Solvencia. Maybe Mike remembers. Anyway, I definitely wouldn't recommend your husband go back to El Salvador while the case is still at NVC. My hubby had to do that because the court said to, but otherwise we would have waited until the interview. Our case took almost a year from the time the NVC forwarded the file to the embassy until hubby had his interview.

fairyofgrace-At my hubby's interview, they said we would need to wait 6 to 8 months for waiver decision. Now when I call the 202 number, they say that the DHS is saying 6 to 12 months from the time they receive the waiver, which as you see from my case and Mike's case, the DHS received our waivers almost 2 months after the interview, so we could be waiting a total of 8 to 14 months for decision. Then I have no idea how long it takes to get the actual visa after approval of the waiver. Now just to clarify, I don't personally know anyone who has finished the process through El Salvador recently, so I am just going by what they tell me at the call center 202 number. I am hoping and praying it will be quicker than they say. We had 3 people from El Salvador on the old forum who were approved back in 2006 and they were approved in anywhere from 2 1/2 months to 4 1/2 months. I wish it were still like that! I hope that by the time you get to the point in the process where your hubby goes to El Salvador, my hubby's case and Mike77's wife's case (and maybe mamita3 and luisymary) will be finished and we will know how long it actually took. I feel like we are blazing a trail here. (I might add that it does not seem to be blazing very fast right now though) :)

Hey, Paige! I hope all is well for you. I can't imagine how anxious you must feel right now with waiting for an approval and getting ready to welcome a new, little one. My heart goes out to you and your family right now. My question is, why do you think now there is such a LOOONG waiting period for an approval from El Salvador? Or why the delay? :waiting: I was just wondering if you had heard anything in regards to this...

Paige,
I am not sure about the interview date but I do know that they changed several things in March this year. For instance there is now 2 interviews for the visa. They make you an appt. to turn in the visa application and then you have to go back 1 week later to have the interview with the consulate person. I to thought that we had to sign the papers and return before they scheduled the interview but my attorney said they will schedule the interview for mid August and when I call the NVC and talk with a person they say the interview should be scheduled in July or August but that it wont be until next week June 9-12 that we would know for sure the date. I do not know if that is just what they tell everybody or if they will actually schedule the interview that way. We will have to wait and see. I will let everyone know when I find out for sure.

mamita3- I have no idea why it takes so long. When hubby turned in his waiver they were accepting them on Wednesdays only and hubby said there were about 25 people there when he went. I don't know if 25 a week is normal or not, but it seems like they should be able to get those processed fairly quickly. Of course, I don't know how many staff they have to process the cases. Maybe they are short on personnel right now. Hopefully it will be better by the time you file your waiver. With regard to feeling anxious about the baby coming and hubby not being here, I think we are doing pretty well most of the time. We both have our moments when we feel depressed, but then we try to count our blessings and remember that God knows why we have to wait. Someone reminded me just recently that we tend to say that God is so good when things go our way, but when things don't go the way we think they should, does that make God any less good? We should sing His praises no matter the situation because He is good all the time.

luisymary- I hope that they have improved the process now so that you don't have to wait as long as we did for our interview. Please let me know what happens when you call. You will call this week, right?

luisymary

We received the package late January 2007, my wife was 2 months pregnant, and we asked our lawyer if she can delay the interview, she said yeah for 1 year, so 2 months after my wife went into labor we called Visa Center to make the appointment (just like the letter stated), but then we were told my wife Yanet needed to be in El Salvador for her medical check-up, then they would allow us to make the appointment. But like i said it was pretty horrible trying to get an appoinment, i went 2 weeks calling the Visa Center, I've spent closes to $70 dollars on calls to the VisA Center just to tell me they did not have the schedule for the folowing available month (January 2008).

My wife and I went to the interview. She followed her appointment by going a week later to drop the waiver,(no interview or anything like that this time). She did see like around 15 people leaving their waivers, but majority were turned-over becuase they did not have all the paperwork, i guess they did not have attorneys.

It's very disappointing that INS tells you one it takes 6-8 months, the embassy 12, and DHS another 6 months after they received the waiver, at this point, i'll just wait and let God continue molding our lives.

From your experiences, do you feel a lawyer is necessary for the waiver? I guess you wont really know until everyone starts getting their responses, but if you used a lawyer does anyone know of a lawyer that has a lot of experience in El Salvador waivers? I know Laura has most of her experience with Mexico waivers.

Paige
06-24-2008, 05:16 PM
I think it depends if your case is complicated or not. I didn't feel comfortable to do our waiver myself since hubby had a criminal record. However, the lawyer I used had pretty much zero experience in El Salvador. If you find one that does a lot of El Salvador waivers, you should ask how long the waivers are taking to be processed recently.

I am glad to see other people from El Salvador. My husband is from La Union, El Salvador and has been here since 1993 EWI. He applied for Asylum in 1994 due to the violence and guerilla during and after the civil war. He has worked ever since then with an EAD every year. We met in 2004. He had his interview for Asylum in 2005 (11 years later). We did not realize though it was the offical interview and of course his application was not approved but never denied. He was sent to immigration court in removal proceedings. We married in June of 2005 and our daughter was born in August of 2005. We filed the I-130 in June of 2005 and it was approved in September of 2005. The application got "lost" due to the removal proceedings. He applied for Temporary Protected Status and was approved in April 2006. His case was closed in the immigration courts. He is still working with a pending asylum EAD that he applies for every year because his application has still not been "denied". His case was sent to the NVC in April 2008 after almost 2 and 1/2 years. We are going to see a lawyer to find out our options. Since his only illegal time was before April 1997, it doesn't count as "unlawful presence". I don't know how they are going to prove the whole "bona fide" asylum application rule also. If they say it wasn't "bona fide" then we will need a waiver also. It is just great to see other people and receive support. I wish every one the best. Any help or expirences from El Salvador please share them.

Did you were contacted by DHS regarding additional information that was missing or something like that?..i am just curious, my wife is always ready to answer the phone, she thinks it might be from the embassy or DHS needing more information or something like that.

I will be traveling to ES the 1st of august for 2-3 weeks, we will be celebrating my little girl's 1st birthday...
good luck to everyone.

reyluna, what dhs phone number did you called?. When i called 2 months ago, they asked about the receipt number (i130 ) of the case, i didn't have with me, i have to look for it, i have som much junk. But when i gave them the case number they said that number is only good for the embassy records...so i 'd called the NVC Call center (the place where you pay $7 dollars a call), that's the way i was able to get the status...maybe i should try again this week

Many many congratulations reyluna!!!! Has the embassy told your wife what she needs to take there in order to get the visa or told her how long it would be? They told my hubby to take pretty much all the same stuff we took the first time. He needs to get the Solvencia de la Policia, medical exams, tax forms, etc. again and they said it should be 2 weeks from when they get all the required stuff. I'm interested to know if they told your wife the same thing.

paige,

when the embassy called my wife they told her that her i601 waiver was approved. they also told her it would take from 2weeks-1month before her next appointment at the embassy im guessing thats when she gets all done with the case. she already handed in her medical exams, tax reports, and police records from here u.s.a and from el salvador when she went in the first time back on 09/11/2007. they just told her that they would call her within that time period (2weeks-1month). my wife said she needs to pay a fee there so that dhl, ups, cargo express what ever they use as for delivering can overnight her passport to her home address there in el salvador because they also took that away from her the very first time. after she receives the passport and some type of evelope the embassy gives her she can come back home.

i dont know if thats what your husband is going through aswell. does that sound right to you?

reyluna, I think you should send your wife an updated I-864 and your W-2 for 2007. Anyway, they required updated ones for my hubby since the ones he handed in in November were from 2006. I guess they want the most recent tax year to see if you can still support her. My hubby's understanding is that they want him to take everything to the embassy, (new tax forms, new medical exams, new solvencia, new pics, etc-they gave him a list), and then he needs to wait 2 weeks for the visa. He didn't need to make an appointment to take the documents, but they only accept them on Wednesdays.
Edit:
luisymary, Congratulations!! Great news!! Wow, that was quick! They made us wait a year. I really think maybe our case was lost for a while.

For those of you that went through El Salvador is there such a thing as "a long birth certificate" ? do you need it for the interview?

I'm seeing in the Mexico forum that they want you to have a long birth certificate at the first interview "with hospital information" as oppsosed to a short birth certificate. My husbands birth certificate is a copy of a hand-written document and nowhere does it mention hospital information. Just wondering if this is a Latin America trend or just Mexico? The people who have gone through San Salvador should know, hopefully.

I don't recall my wife's birth certificate having hospital name on it. At the day of the interview, they did not have a problem with the birth certificate.
