Dear Sir/Madam:
If Alien is not admitted to the United States, I will suffer extreme and unusual hardship above and beyond what I have already suffered. A separation between my husband and me would be the most devastating event not only for me but for my son also a 11yr old United States Citizen. My son’s biological father would never consent that my son moves with me to Guatemala due to his parent’s serious medical conditions and concerns of his son’s safety in a third world country (See Exhibit 1) and this places me in an impossible situation. I would be forced to choose between my son and my husband, which is inconceivable because both of them are part of me.
BACKGROUND
I divorced when my son was only two years old; as he grew up I faced many difficulties, financially, professionally and emotionally. My son was not able to control his impulsivity and could not pay attention to instructions this prevented him from having friends, felt refused by peers and was not receiving a proper education. He was expelled from two different educational centers (See Exhibit 2), our self esteem was so low, and I felt guilt and a sense of despair. After seeking professional help my son was diagnosed with ADHDE (See Exhibit 3) this protected his rights in school and was not judged as a child with behavior problems. Even with medication my son was having problems (See Exhibit 4) While attending kindergarten I had to quit my full time job and worked part time for a period of time to be able to attended school with my son everyday to witness his behavior and help him stay in a classroom. Working part time as self employed put me in a very difficult financial situation (See Exhibit 5) but some how I survived it. I keep my self single because I knew my situation would be unattractive to a prospective husband.
Our life changed dramatically in 2005 when I met Alien, (See Exhibit 6) I truly believe he is an angel who came to rescue us. My son XXXX was immediately attached to him emotionally because he received the attention he was lacking. As the relationship progressed Alien was interested in learning about XXXX’s condition and how we could help him. I had to move to a different city because I was hired by the United States Postal Service on January, 2006 on probation basis working 10 to 12 hours daily for 3 months. That is when we decided we would get married. As an effort to obey the United States immigration laws, we planned for Alien to stop working and stay home to take care of son (See Exhibit 6.1), supervise homework and attend school meetings, functions e.t.c. (See Exhibit 7) As a result of this meetings son was diagnosed with Aspergen Disorder (See Exhibit 8) This condition helped us to understand his difficulties to inter act with peers, his eccentric behavior. He is at risk for other psychiatric problems including depression, schizophrenia and obsessive compulsive disorder. With my husband’s support and dedication our son takes a daily morning dose of 15 mg Adderall XR, had a very structured daily schedule and was performing well in school.
My son adores my husband; to him Alien is his father. He calls his real dad his other dad. My son is so attached to him that I believe he would suffer an irreparable damaged emotionally in a way that I cannot conceive. (See Exhibit 9)
Our son not being able to travel to Guatemala due to his biological father denial to approve for his passport would loose the opportunity to grow the most difficult years of his life with out a father. In 10 yrs he would be 21 yrs old.
HEALTH
My 73 yrs old mother who is a second mother to my son is very sick with hearth problems, had hearth surgery to replace a valve and to insert a pacemaker. Her diabetes is damaging her kidney and she is losing her vision. She also is treated for high blood pressure (See Exhibit 10). Since my teenager years, I have been the primarily care taker for my mother, taking her to all her Dr. appointments, giving her medication, supervising her diet and checking her sugar levels and monitoring her blood pressure daily. This situation changed when I was offered a job as a mail carrier, a job that I been waiting for years this event forced to move to Ramona California, and later to Oceanside, CA. only 45 minutes away from my parent’s place of residence. I still see them on my weekends as an effort to assist my brother & his wife who are temporarily taking care of them. (See Exhibit 11) As soon as I am well established, my parents will move in with me (See Exhibit 12) and with my husband support, we will provide a happy and secured future until the end of their days, treating them with love, respect and dignity. If I am forced to move to Guatemala to be with my husband I will not only leave my parents in a vulnerable state, but I will be devastated that I will not be able to provide for them. Currently my parents are feeling affected emotionally with my husband’s absence they love my husband and they enjoy sharing their life time stories with my husband Alien. They are very worried about my marriage and my son’s future. (See Exhibit 13) Our separation is affecting them and I fear my mother’s health could worsen.
Even before my husband left the United States on July 17, 2007, I have experienced many episodes of shortness of breath, severe palpitations, and dizziness. I was sent to the emergency room in two occasions (See Exhibit 14) and have been visiting urgent care constantly. After several tests and examinations, my doctors concluded that my symptoms were indicative of depression and anxiety disorder from great stress. (See Exhibit 15). I had refused to take medicine for depression in the past; I am currently taking 20mg of Prozac which also helps me with sleeping problems I was experiencing.
My son’s Health condition of ADHD & Aspergen’s Disorder (See Exhibit 16) increases my stress and Anxiety. With out my husband monitoring the structure my son was following, our son is getting back to some old habits hurting the progress. I need to stay in the U.S. to find support and continue with the medical plan that he has followed since he was 5 yrs old. In addition he is treated with alternative medical programs like the Drake Institute (See Exhibit 17) this programs trains his mental waves to increase his concentration, this treatment gives him the opportunity to perform to the fullest of his potential.
It is medically imperative that we start our family in the very near future. If I had to wait to have children until after the 10-years I would be at least 48 yrs old. I would suffer a decline in fertility and our children would be at a high risk for birth defects. (See Exhibit 18) So much of my life has not been ideal; please don’t make this dream also die unfulfilled.
FINANCIAL
The American dream would only be possible for me with the support of my husband; as a divorced mother I was not able to buy a house always fearing my salary would not be enough, with my husband’s income we would be able to afford buying a house. My son and my parent’s future depend on this. While maintaining my current job, my husband and I plan to start a business (See Exhibit 19), cleaning offices during the night and he would work for my brothers in a Neon Sign business. My brothers who learned this trade from my father have special interest in teaching him their techniques in this unique profession. (See Exhibit 20)
I am currently a career mail carrier working for the Unites States Post Office. (See Exhibit 21) This job offers me benefits like medical coverage for the whole family, job security, life Insurance, retirement, thrifty savings and flexible spending account that allows me to pay out of pocket health and dependent care with tax free money. (Exhibit 22).
In order to maintain our marriage alive I would need to travel constantly to my husband’s country of origin and make frequent phone calls, these expenses added to my current debt of over 10,000 in credit cards and personal loans (See
Exhibit 23) would put me in serious economical problems and affecting the time I spend with my parents and the quality of life I offer my son.
EDUCATION
The Unites States of America gives me the possibility to continue my education. My goal is to finish a career in Advertising & Marketing to be able to work in the USPS Marketing Department and apply my years of experience to target the Hispanic Community increasing revenue for the USPS (See Exhibit 24). Other education goals are to renew my notary public commission, apply my knowledge as a certified Notary Signing Agent and I am currently taking a course in tax preparation.
Our son’s education is a priority for us and it requires that he uses special machines to help in school and home work, special education classes and programs to help with his learning disabilities (See Exhibit 25). He has goals that he can only achieved if he continues education in the USA where programs are develop for individuals with such needs. He wants to be a scientist; it is known that persons with Aspergens disorder have been known to be successful when they show a special interest (See Exhibit 26). Alien and I have a commitment to send him to University to pursue his dreams. (See Exhibit 26)
My husband, if allowed in the United States plans to explore the education programs available to advance in the goals he has set to succeed as a small business entrepreneur.
GRAVE SAFETY CONCERNS
XXXXX my son’s biological father is very pleased with the affection and dedication Alien has toward his son and he is very graceful about Alien guiding son as a father but he would never approve for me to take my son to another country. Due to his parents health it would be difficult, almost impossible for him to travel to visit. He believes my son would not be able to receive the adequate education, medical treatment and his safety would be in jeopardy.
XXX fears our son XXXX would be living in poverty conditions in Guatemala, under a dysfunctional law and judicial systems, vulnerable to violence and crimes such as assault, theft, armed robbery, carjacking, rape, kidnapping and murder. (See Exhibit 27)
Guatemala public hospitals frequently experience serious shortages of basic medicines and equipment. Language would be a barrier to continue his education and his medical condition would be wrongfully confused with behavior problems. (See Exhibit 28)
Criminal Penalties: U.S. Citizens is subject to Guatemala’s laws and regulations, which sometimes differ significantly from those in the U.S. and may not afford the protections available to the individual under U.S. laws. Penalties for breaking the law can be more sever than in the United States for similar offenses. Persons violating Guatemala laws, even unknowingly may be expelled, arrested or imprisoned. (See Exhibit 29)
As foreigners to Guatemala and because of the difference of culture and language, I would be an easy target for possible kidnapping (See Exhibit) and face suffering as many other women in the country victims of sexual violence, torture and murder. (See Exhibit)
SUMMARY
Our life was uncertain until Alien brought, hope, happiness and love not only to me and my son but also to any body that has the fortune to meet him. I am in a very difficult situation that stops me from moving to Guatemala, my son and my mother require medical attention and my personal participation. For my son’s well being I must continue my effort in the USA to increase his opportunities in life. He is GATE qualified an indicative that he has the potential to succeed in life (See Exhibit 30).
CONCLUSION
My husband regrets the circumstances by which he came to this country 3 yrs ago. His current status causes him a lot of pain and embarrassment. He understands his actions are now affecting the life of many people. He wishes more than anything in the world that he is given an opportunity to make an honest living in the United States supporting a University education for my son, future children and supporting me in my moral obligation to take care of my parents. (See Exhibit 31).
I am an honest U.S. citizen. I have worked hard to meet all my obligations and raised my son as a divorced parent. I am proud to be part of this great country, I represent the United States by performing my best as a mail carrier, and I contribute to charity through the Federal Combine Campaign. I have served as a Notary Public, pay my taxes on time, voted in elections, and obey the law. I humbly ask the U.S.A. government to recognize my sincere contributions as a citizen and consider my hardships to permit Alien to return to this country so that together as a family we make our dreams come true. Alien and I are prepared to spend the rest of our lives together supporting each other, our son, future children and my parents. I respectfully ask that this waiver be approved.
