I am new to this forum, but have been amember of other forums for a bit ,but u guys give good advice and prompt responses. This is my issue i file I130 noa 7/2/07, latest news is i should recv a response by jul10/2008.So I put in for an expedite with uscis a few days ago for the K3 which i submitted back in oct now mind you both of these petitions are out of processing times per website.The reason i did this was because k3 was supposed to allow spouse to enter more quickly,and then get an email from uscis saying they cant move forward and my k3 case has been delayed,because background investigation is still open ,and is a requirement by all aliens seeking the benefit my hubby is seeking.My thing is why are they doing background ivestigations ,instead of background checks,or are they two in the same here?.Also one petition says within 3 mos from april ,and this k3 says within 6 mos or call uscis cs svc. I also recv letters from senator and congress on my behalf, and senate says they r in touch with embassy but the lady there is so rude, why r they in touch with embassy at this level. Im just scared they may be denying him but y take so long to tell me i just cant see y uscis would be investigating when their main concern is criminal etc security and genuine marriage this should be up to the embassy level,for what they are doing now. Please anyone help me out i am so nervous i am anxious to know whats the hold up. I have never seen anyone have to wait nearly a year for just an approval with uscis.I may be in the wrong area here but i may have to file waiver but i am going to god for positive feedback...

Give us more detail about your case? Please? When did you married? Does he has any criminal issues?

Thanks yall,

I was married 6/6/07 filed I130 on 6/28/07. To my understanding my husband has never been in the usa, and he does not have a criminal record in his home country at all. I dont the reason for background investigation per uscis. i recv no rfe or anything. The only thing about my case is i am just filing for him to bring him over, but he did state to me that someone filed for him some years back, but the visa was cancelled but we cant get into detail because uscis and other agency have started accessing people privacy info like emails and phone calls have u guys heard about it. I dont like to speak to much over phone, but when i go back to see him i will.

That is so weird!! Maybe becuase you applied that same month? I applied a month later. That is really weird I know that your going thru a diffrent country, maybe that's the reason? Well it's being so long. Are you a USC?

Yes I am , I just can seem to figure it out I have seen maybe 2 ppl that had to wait this long for an approval notice.I have tried all avenues, just praying that ombudsman can do something or shed some light. I will have to wait a couple of weeks for his response i guess. Anyone get positive results from ombudsman at uscis?.

thanks guys they said someone with the same name as my husband has an A number,and they were transferring the file, but when i asked cst svc supervisor,she said every applicant is assigned an a number and that is something that they say. Anyone can clarify this.

I think you have the problem that your husband is being confused with someone else of the same name at the "name check point" in the process.
I have read on this site (and elsewhere) that this sort of confusion - when a name-check leads to questions - can result in a much much longer processing times for the background check.

I hope you can get it sorted out soon - it would make me madder'n'hell.

thanks doug appreciate it .thought that too because they said someone has his name and were transferring the file, but that was months ago they told me I should have an answer by july10th. i pray we do
