Could you all review my hardship letter, this is a very rough draft!
June 14, 2008
Reference to: Mr. XXXXXX
I, Genevieve XXXXXXXXX declare under penalty of perjury under the laws of the United States, that the forgoing is true and correct. My name is XXXXXX . I am the petitioner for my husband XXXXXXXX .The receipt number is; WAC-XXXXX and WACXXXXXX from NVC. Immigrant Visa Case number is: SOFXXXXX.
The primary reason that I am asking for a Waiver of Extreme Hardship is because I need my husband to be able to be with us in the United States, and to help me take care of our son GXXXXXXXXX who is classified as a child with “special needs and developmental delays”.
Dear Consulate Official,
I am writing this letter in regards to the I-601 Petition that was filed for my husband Mr. XXXXXXX . The purpose of this letter is to provide documentation of hardship to my Family and myself. The absent of my spouse XXXXX , has proved to be an extreme hardship for us, as we not only miss him and love him, but we depend on him in every aspect of our lives. As his spouse, I hope to prove not only through this letter but also through documentation that is included that XXXX absent is affecting us emotionally, financially, physically and medically.
If my husband is not able to return to the United States, it would cause severe emotional and financial trauma in my life. We have been together for almost 3 years and married for One Year.
Because we are compelled by our legal and emotional marital bond to remain united, I would be forced to move to Bulgaria if he is not allowed to return here legally. There are many reasons why this would be devastating to my life. I would be estranged from my family in the United States, abandoning personal career goals and unable to provide for My Special Needs Son the Medication and all the Special services he is now receiving, Magnifying all these issues is the fact that I do not speak Bulgarian and will be isolated and incapacitated living in the country of Bulgaria, I wouldn’t feel very safe there,
We met November 11, 2005. We have been married since May 26, 2007. USC writes this letter in support of the waiver. My husband has already lived in the US for 10 years and has made a Life here, friends, family, and has many obligations here.
There are several interacting hardships:
MY CHILD:
I have a adopted Special needs child named, Gabriel Noel Pawelkowski D.O.B. November 9, 1997. He was adopted through the Department of Human Services, was abandoned in the hospital at birth. He weighed 3 pounds, was a very sick preemie and has many medical problems. He has growned very close and attached to my husband almost 3 years, and sees him as his real dad. The separation has cause him great grief and anxiety. He is always crying for his Dad and worried he wont see him again.
Gabriel was born with an extra X Chromosome which is called Klienfelter-Syndrome (documentation attached). This extra X causes Speech problems, auditory expression problems, neurodevlopmental problems. He also has abnormal muscle tonas in his truck and extremities with significant joint laxity. Motor skills are delayed with atypical posturing and decreased flexion, extension and rotational components. Gxxxxl has decreased pelvic mobility which affects all aspects of his motoric organization. Boys with XXY often have hypotonia of the truck which affects their motor planning of paper and pencil tasks at school. Gxxxx also has developmental dyspraxia which is seen in many children with sex chromosomes.
Klienfelter Syndrome also causes aggression and anger outburst and rages as they mature, I have reports from school(letter attached) that states Gabriel is aggressive and out of control at school. He has become violent towards me on several occasions.. GXXXXX Medical is covered in full from Tenn-Care, ( our States Insurance) since he is a Special Needs child adopted through the State of Tennessee. All his medications and Doctor and Dental Visits are covered. This would not be available in Bulgaria. I also receive Adoption subsidy from the State of Tennessee for this child $481.00 a month and Social Security check of $388.00 a month for this special needs child, plus $388.00 a month for me. I would lose all that if I have to leave the USA(Documents attached)
Developmental Dyspraxia is a disorder characterized by a impairment in the ability to plan and carry out sensory and motor tasks. Generally, individuals with this disorder appear out of sync with their environment. Symptoms vary and may include poor balance and coordination, cluminess, vision problems, perception difficulty emotional and behavior problems, difficulty with reading, writing, and speaking, poor social skills poor posture and poor short term memory.
Developmental Dysparxia is a lifelong disorder. Many children compensate for their disabilities through Speech therapy. Gabe presently takes Speech at school. Gxxxxx currently has an IEP education plan at school to help with his needs.
Gxxxx also has GER reflux which causes projectile vomiting, constant gagging and has severe allergies (attached paper) Distinguishing between normal, physiologic reflux and GER in children is important.. Reflux that continues past 1 year of age may be GERD. For example, GERD can present as repeated regurgitation, nausea, heartburn, coughing, laryngitis, or respiratory problems like wheezing, asthma, or pneumonia.
He takes medications daily, such as Trazodone 100 mg 3 times a day, Clonidine 0.1 mg at night to sleep, Concerta 36 mg, 1 a day, and Prednisolone 15 mg for his severe asthma.
Gxxxx has to have breathing treatments when his asthma acts up, we have a nebulizer machine from the Hospital that we use at home and he takes Ventolin and Nasacort and Albuterol Solution for his breathing
GXXXXX has also been diagnosed with ADHD (Attention Deficit Hyperactivity Disorder) and CONDUCT DISORDER, which is a version of ODD oppositional defiant disorder. He also sees Dr. Ben Kadas (statement attached) every 4 weeks for therapy and monitors his medication.
It is literally impossible for me to handle GXXXXX on my own. I need my husband in the home to help me with all the aspects of this child’s life. GXXXX is very emotional, cries easily and very fragile at this time. If My Spouse DXXXX is not allowed to return to the US, he would suffer tremendously, Like any Mother I want my son to be allowed to have all the choices and possibilities that I had growing up. DXXX and I deeply believe that we can not accomplish this if living in Bulgaria, and My son couldn’t get the best medical care. Also, as GXXXX matures, around age 11, he will need a Pediatric Genetic Doctor because his body will not produce the male hormone Testosterone, so he will need these Testosterone shots and has to be monitored very closely, because the dosage has to be adjusted.. GXXXX currently has an IEP education plan at school to help with his needs.
PSYCHOLOGICAL / EMOTIONAL:
If XXXXXX had to stay in his country Permanent isolation from Me and GXXXX would result in tremendous stress, anxiety, and depression. The psychological / emotional impact on USC would be devastating.
DXXXXX has developed a strong parental bond with his stepchild. The adopted father(ex-husband) (R PXXXXX doesn’t phone, visit or provide any financial support. For the sake of his stepchild’s upbringing, DXXXX provides the fatherly guidance, support, and love a child needs while growing up. We do not want to separate the bond between his stepchild and mother. USC wants to keep her family together. The psychological and emotional stresses are overwhelming.
I Need DXXXX support and help with my child financially and emotionally. GXXXX has a hard enough time with his speech here in the US, He could not adapt to another country, language and culture.
Since USC can’t speak or read the language, it would be very difficult to accomplish anything on the Bulgarian economy. Simple task such as shopping, dining, entertainment, or just asking for directions becomes monumental.
For me, all this is possible only if living in the US.
My ex-husband would never allow me to take GXXXX out of the country. He visits his Dad once a month for 2 days.( RXXXXXXXXXXX ).
MEDICAL:
I am having significant health problems such as Hypertension, anxiety, and depression, and I have a history of Panic Attacks. I have headaches, and Insommia. I am currently taking Xanax 4 times a day to cope with the separation from my Husband and the stress of trying to take care of GXXXX alone. My husband helps with him a lot, because he is very defiant and has anger outburst and he becomes destructive in the home. DXXXX helps keep him under control and also helps with his bath and feeds him his breakfast and supper, and gives him his medication because I work. GXXXXX is 10 years old, but in reality he is about 6. His IQ is on the border of mild retardation. He still can not read or write He requires a lot of Supervision and Guidance.
MY PARENTS:
I lost my Dad 5 years ago, I only have my Mother left who is in very poor health and lives in a Nursing home in Houma, Louisiana. She has had several strokes and has fallen and broken her hip, and had surgery recently. Her memory is poor, and she has been hospitalized twice and on a respirator, because of congenial heart failure. She is very important to me and I couldn’t leave her at this time. She is 89 years old now.
EMPLOYMENT:
By leaving the US, I would be forced to leave my job, I work in Retail and am a Licensed Cosmetologist and the salary scale would not be the same for me in Bulgaria. The financial situation here now is extremely hard for me, because I need DXXXX financial support here, and there is no way I can make it on my own. I miss my husband painfully and am uncertain of the future for me and my son. My husband has a good job waiting for him in the United States, so he can support his family.
SUMMARY:
This Marriage of One Year has come full circle and needs to be recognized for its family unity which is one of the foundations our nation was built on. He would be unavailable to his family especially in regard to His Wife and step-child. I have no immediate Family with me here in Tennessee; I only have my husband DXXXX . If BG Citizen is not admitted to the United States of America, USC will be placed in the midst of an impossible dilemma. My son’s medical needs could not be meet and we would lose the benefits of Social Security and Adoption subsidy assistance.
CONCULSION:
I plead with you to forgive my husband and approve this waiver. It is our hope that the United States Government will have the compassion and forgiveness to keep our family together here in the United States. Please consider our extreme hardships of not just our health, business and financial situation, but keeping our family together and raising our child with the opportunities that they will only be given here in the United States.
I respectfully request the Waiver to be approved, and DXXXX IXXXXXXXX to be allowed back on US Soil, and to be reunited with his Family in the United States.
We want to keep our child here, keep our home here, invest in our community and continue contributing to the U.S. economy. We have many hopes and dreams as well as responsibilities and liabilities that hinge upon our residence in the U.S.
I urge you to consider the extreme hardship and duress that would befall me, if you were to keep my beloved husband out of the U.S. long-term.
Thank you for your consideration. I eagerly await your reply.
USC and Bulgarian Citizen respectfully ask that this waiver be approved.
Thank You for your Utmost Consideration in this Matter
