I am an American citizen with a illegal wife we have two children and my wife has to voluntary depart by Sept.5 and my lawyer is not helping so I an taking matters into my own hands. Considering mt 16 month old daughter's medical condition and her therapy I want to try the pilot program at CDJ but the I-130 was approved but the NVC has not recived it and all the appounts are not hear and she has to leave so time is almost up can anyone help.

David - welcome to the forum. I posted a reply to your other message - on the 601 thread.

Now that I know what stage of the 'game' you are in - I can not offer much assistance. With an I130 approved - and case not at the NVC yet - you are still looking at over a year before you will receive your appointement date in Mexico.

When was your I130 approved?? Your case should be recieved at the NVC within 2-4 weeks of approval on the I130 and processing takes anywhere from 3-4 months (at the quickest) to as long as you want it to. Obviously in your case - it would be a matter of getting it completed as soon as you could.

After that - is when your first appt gets scheduled. As I stated, they are taking approximately 1 year to schedule at this point. I am not aware if you can request an expedite for your first appt or not. I have not heard of this ever being done - but that doesnt mean that it can't be. Depending on your daughters medical condition - it may be grounds to try....

The stage of the process that involves the pilot program takes place AFTER your first interview in Mexico - and really only affects the filing of the 601 waiver. I explained it a little more in my other reply to you.

I am sorry that your wife was given voluntary departure. Is there any way you can request a later date? Extend it at all? I can not imagine the suffering that your family is going through, but this process is not a fair or just process for spouses of US Citizens - and nothing about the process to legalize your loved one is ever quick!

We had one member on here whose 1 year old needed a bone marrow transplant. Her other toddler was going to be the bone marrow donor. She was able to get the entire process expedited at each step of the way. She was assisted by her elected US House of Representative member.

She had to just keep involving elected officials until she found one that would help her.

I don't know how serious your situation is. Obviously each situation is different. But if the situation is serious enough it can be done fairly quickly.

But if your situation is not that dire then you will be unable to get it expedited.

It is a waiting game.
