My I-130 is going thru Vermont, does anyone have info on a timeline for when we'll get approved , get an interview ?????? I know about the USCIS processing timelines BUT it's rumored that those aren't exactly accurate. :shy: one friend actually said she got her's way earlier then what the USCIS chart said.

I-130's are at about a six months wait they predict. Right now the processing times say they are working on Jan, but that is not alway true. I saw on another fourm someone sent in their I-130 in April and it was approved last week. I am not sure if they were Vermont, but I would expect 3 - 6 months. As for the interview that will depend on where the consulate is....are you filing in CDJ? That is about a year wait after approval.

see this is where i get confused :D no , its in La Paz Bolivia. So does it take 6mos to get to La Paz and then more months till the actual interview ???

imisshimmuch - as angela said - it can take up to 6 months right now for your I130 to get approved - although it will most likely be quicker than that. (but reality is that it could be longer too...) According to the VJ website, vermont is processing I130s in approximately 127 days. (this info is based on other people's timelines who are filing the same form through the same service center) It is just a rough estimate though and it fluctuates daily!!
After it gets approved - your case will get sent to the National Visa Center - more forms, more fees - more time. It can take 3-4 months, or longer if you delay in sending forms back.
After that -- is when the interview will be scheduled. I am not familiar with the timelines in Bolivia - so I dont know how many more months it will take from that point.... maybe someone going through bolivia can speak up?!?

i'm going through vermont too...when did you file? and yes, i've been given an estimate by my esteemed and highly experienced I2US comrades that i could possibly be looking at an interview in cdj in early 2009 if all goes well (i just filed last week, so that should give you an idea, depending when you filed.)
hmm, bolivia. i haven't seen anyone going through bolivia before. welcome! we should make a map of all the i-601 countries people are going through. ratito...how do you do maps?

We turned in our I-130 in mid July of this year thru Vermont.
Well it looks like waivers filed in Bolivia get adjudicated in Lima, Peru. So after your waiver package gets to Lima from Bolivia it generally takes about 6 months for a decision and then it will be sent back to Bolivia and they will arrange for the visa pick-up.
As far as I know, you are our first person to file through Bolivia.

Thanks Pinkpig - It's odd that the waiver will take shorter then the rest of the process, my lawyer said it will take 8 months for the approval of the I-130 and another 6-8 months for the interview............. I guess i just need to learn patience right ?? :thumbup:

Approvals take different times depending upon the locations and the charges...all of the timeframes are just generalizations.
But patience is the number one thing that you will need going forward in this process.

We mailed our I-130 on August 13 and it was received on August 15. However, no NOA1 yet. A lot of people on visajourney.com mailed their I-129f to Vermont around the same time and they have already received their NOA1. We can't file our I-129f until we receive the notice. Any updates on people who filed in August and have received their NOAs? We are just now starting this process and I am already stressing out. Wow! I will be a basket case by the time this is over.

djones, i mailed mine a few days after you and i haven't received a NOA either. i'm kind of expecting it any day now because some july people had a relatively fast NOA receipt time. let me know when you get yours because i'm assuming that i'll get mine around the same time.

I think ours should be coming soon. I say this because I was waiting and waiting for the certified mail, return receipt green slip. We never received it back in the mail. Whenever I would go to the USPS website and trace the number, it says that it was delivered by the Post Office on 8/15. However, still no green receipt. Well, we finally received it in the mail on Friday and instead of a signature for the person who signed for it, it has the USCIS stamp on it. There is absolutely no way it should have taken over 15 days for the Post Office to mail it back to us. I am thinking that it was probably returned to us by USCIS when they got to our package.
I will keep you informed.

i didn't do the return receipt--i just did delivery confirmation through the website, and it said they got it on 8/19. i think i would start to worry if i haven't gotten a NOA within a month.

got the noa1 a little more then a week after we mailed, but i'm sure as long as it in the computerbase it's good, you'll probably get the hard copy soon
now just waiting for the NOA2 so we can move on to the NVC part

I had sent my husband's on 7/26 and we only received the NOA1 this past Tuesday, 09/04! Although on 8/20 we received the Biometrics Appointment Letter...

This person from visajourney.com just received their approval for the I-130 and I-129 from Vermont -- 2 months to approve counting from date he originally received NOA1. Wow!

Nothing yet. This Friday will be 1 month exactly since we filed. I can't stand this wait. I understand that we can file if we receive a copy of the cancelled check but so far, even the check hasn't been cashed. Will keep you posted.

Just spoke to USCIS. They are asking people to wait 90 days. What the hell? I asked if we could file the I-129f without the Receipt Notice? The gentleman said that he could not say whether or not they would accept a copy of the cancelled check or the post office receipt notice. He definitely knew that they would accept the NOA1.
However, if you look at the new instructions for the 129F, no where does it say that you HAVE to submit the NOA1 from the I-130 as evidence. It only states "must also include evidence that they have filed Form I-130, Petition for Alien Relative, on behalf of the alien spouse limited on this form, and a marriage certificate evidencing the legal marriage between the citizen and alien."
However, in the instructions under "Form I-129f Filing Locaions for K-3 Spouse" it says to mail your petition to the Service Center where the underlying I-130 petition is currently pending. "Use the address listed on your most recent receipt notice or transfer notice and include a copy of that notice with your Form I-129f."
I am assuming this is saying to include a copy because a lot of the applications are transferred and this would make sense to include a copy.
When I called him, he did not sound at all concerned if I were to send some evidence other than the receipt notice. Is it worth the chance? What's the worst thing that could happen? They reject it and send it back -- right????

hey, i'd go for it. i'm not doing the i-129f, but you don't have a lot to lose at this point.
i know i'm being really whiny about this, but i know you (and a lot of others) share my pain so i hope you don't mind...so we're supposed to wait 90 DAYS FOR A NOA1 and some people are getting APPROVED in 60 days, and others got an NOA1 in a week or so???????????????????
i don't think there's a smiley for my emotions right now (and do we call them frownies when we're not happy?) but i'll try: :curse::angry::bang:

Jsierra - I know you read my post in the other thread regarding the dates that USCIS processes your petitions by - and this is what I found on the USCIS website:
U.S. Citizenship and Immigration Services (USCIS) advises customers that, due to a tremendous increase in the number of applications filed, processing of fee payments and entry of cases into our tracking system is behind schedule. As a result, applicants can expect notices of receipt to be delayed. USCIS is working hard to deal with the increased volume.
Delay in fee processing and data entry will not affect an applicant's Change of Status or Extension of Stay eligibility if all other eligibility requiements are met. USCIS continues to process Premium Processing Service requests within 15 days.
USCIS will honor the actual date that an application was received in our mailroom; this date will be indicated on the receipt (in the Received Date box) when Form I-797, Notice of Action, is mailed. Until this situation is resolved, USCIS will provide these weekly updates on progress in issuing receipt notices to our customers. We appreciate your understanding.
So it does seem that even though you have not received your NOA1 - if they have received your petition, it will in fact be processed by the date they receive it NOT the NOA1 date.
djones - I know this information doesnt do anything for you - still waiting for your NOA1 - but I just wanted to say good luck. The page says that they will update it weekly - so atleast you would be able to track when they are working on. I would think that at some point they have to return to their normal receipting procedures/dates - so its bound to speed up, one would think.

USCIS has now updated their website as of today.
Vermont is now working on I-130 applications received through 7/29/2007.
I think I only have about 5 more weeks to go before I receive my NOA1.

Yes, I am. Did you notice that 7/29 is a Sunday????? I wonder if they are working on Sundays. The Post Office doesn't deliver on Sundays so how could they be working on 7/29 -- could this be 7/30. Let's hope. In any event, I am hoping that they are almost done with July and that August will go really, really fast. Hey, isn't this what you told me. You gave me hope with your scenario so I am going to count on you to come through for me. I will let you know as soon as I hear something.
And also -- like KitKat keeps reminding me -- this date is the date of the oldest I-130 received. S

yeah, hopefully very few people filed after the fee increase (since most of them filed before!) and then we'll see them start moving at their normal rate once they start processing august dates. i know it's unlikely at this point but my heart still jumps every time i open the mailbox. i just think that having the NOA1 in hand would solidify the fact that we've actually started the process.

I still have not received our NOA1 for I-130 filed on August 13, received on August 15. Check still has not been cashed. We filed the I-129f with a cover letter last Thursday and they received it on Monday stating that as "evidence of having filed the I-130, I am providing a copy of our return receipt" as I was told by their office that I could possibly use this as evidence since both the I-130 and I-129f were going to the same office.
So now I will wait and see if they reject the I-129f because I didn't submit a copy of the NOA1 and ask me to resubmit when I receive it. Or else, I could pray real hard and hope that someone would go the extra step and pull the I-130 and match with the I-129f and process both NOA1 at same time.
I will let everyone know as soon as I hear something. If they reject it, it shouldn't take them too long to send it back. If they cash our check, then perhaps that will tell me that my technique pushed them a little.

Wow these waittimes are getting out of hand. And all for NOA1....Can you imagine what we will be waiting for out NOA2's? My I129F was accepted and NOA1 was mailed out right away, but why are I-130's taking so much longer....granted I am at the California cneter, but I thought I would jump in and rant my 2 cents on the processing times.

SHUT UP ANGELA!!! ;) don't make us think about that yet! there are so many of us who are going to be severely delayed for i-130 approval, if it's taking them this long just to put us in the system and get out receipts...
i know i shouldn't complain because my husband is here with me, but it's frustrating to be spinning my wheels like this when we could be moving towards being done with this...he really wants to see his family!

It's all just freaking nuts. I think about my NOA2 everyday just like you all are thinking about your NOA1's. It is so frustrating. I know!! My husband is here with me too, but if he loses his job he plans on going back to Mexico and waiting there and I can't let that happen. I will go out of my mind!
