Did anyone file I-130 and I-212 together? I have to file both and wanted to see if anyone was successful with filing both form together to separate.

The I-212 has to be filed around the time of the immigrant visa interview, which is way down the road from filing the I-130. So first, just focus on that, and then when the time comes, you will file the I-212. Which country/consulate will you be going through?

It would help if you provided some more information and background about the situation...

I think if you just need an I-212 it can be sent in before the visa interview, unlike the I-601, but we'd really need more information.

Thanks for the reply see some information on my wife case below


my wife entered the US 1990 on visa
issued VD 2005
ignored VD and overstayed
picked up by ICE 2007 and deported to Antigua
Married USC 2/2008 after dating for 4 years

Hope this helps. I do understand she will need 212 and 601 if granted to file

In that case there is really no point in filing the I-212 apart from the I-601. When she has her visa interview in Barbados, they will initially deny her for illegal presence and deportation and give her the chance to file the waivers. At that time you will want to have a packet of evidence with a letter or brief that describes the extreme hardship you will suffer if your wife is barred from the U.S. for ten years.
