did she ewi or overstayed? my husband overstayed his working visa and i still got my citizenship... i indicated on my application that my husband had an h1b visa but he overstayed.... when i went for the interview, he asked me the status of my husband and i told him the truth.... he didn't seem to care... he didn't ask me any more questions of why he overstyaed etc... he just approved me right away...

Always make very certain that you tell the truth if asked a question by the officer. An misrep will cause much greater problems than the underlying issue. I read somewhere that having an illegal spouse is NOT considered harboring an illegal alien. (but DON'T RELY:eyes: on that as a legal view)

My husband get his citizenhip through naturalization back on 2003, i EWI and he never had a problem, he started the process on april,by november he was at the oath ceremony!!! of course now the cases are taking longer due to the increases of the fees try to call and find out why its taking so long. but it's not because your wife's status

i had asked this question before from the other forum. My sister was petition by my father when she was single, but my father did not know she was secret married to her husband of now. After she recieved her green card she came back in the philippines to have formal wedding with her husband. Her mistakes was when she filed a petition for her husband here in Manila Embassy, the consulate found out that she was already married when she stepped her foot in american soil which is Fraud and Misrepresentation. She consulated a lawyer in Chicago, and adviced her that she should not appled for citizenship cuz it will open a can of worm . Now her job as a head department nurse, the hospital are wondering why all this years she has not file citizen ship. she asked for another lawyer and advice her to file citizenhip and she did , she also told me she already had fingerprinted. How this would affect her status, will she get deported. she have a nice life in US, and she said she had millions of debts and her daughter luxurious life in US would stop the INS to deport her cuz she thinks this is hardships. I need your opeinion on this. I am afraid that she got wrong advice from her lawyer.

easterlilly, i'm surprised they have not deported your sister when they found out she got her green card through fraud and misrepresentation...i don't know if you watch citizen pinoy on tfc, but this has been a topic already on that show by atty michael garfinkel... and i agree with the lawyer that she consulted not to file citizenship... but since she already has, then maybe she'll get naturalized... i hope they wouldn't find out about the fraud she has... punishment is deportation and lifetime ban unless she has a qualified relative to file a waiver for her and that would be a US citizen spouse or a US citizen parent( i think). consult with atty garfinkel... he had a case similar to your sister's...

yes i watch ciizen pinoy. but i dont think even if she has a qualifying USC relatives in the US which is my parents, she has still have to show extreme hardship. But I do hope she wont get deported, for I know they will dig in to her case...

it would be your parents who would show extreme hardship if their daughter gets deported... i think that's when a good immigration lawyer is needed... atty garfinkel might be able to help, if worst comes and your sister gets deported... i hope it doesn't reach to that point and your sister gets naturalized
