I an currently at the NVC and soon I will need to file I601 for my husband who currently is in europe. He will need to file for the waiver in Vienna. I heard it is very hard to get that approval. We have some hardships but I dont know if they are extreme enough for an approval. I have hired a lawyer to help us.. Has anyone had a difficult time with Vienna???

Vienna is a kind embassy.... However, they will expect you to meet the standard of 'extreme hardship' in a very thorough waiver letter with very compelling evidence to back it up. Not easy- but can be done!

Every consulate has different standards- you can't really compare one to another.

I put my hardship letter up on the board to help fellow Vienna filers. I'lll put the link here.. There are a bunch of discussion on the Vienna thread in this forum that can also help.

We filed in Poland, waiver went to Vienna, set on the shelf for 9 months there, then was transferred to Frankfurt where it was approved in 2 month.

From my experience, Vienna replies to the emails, they at least giving you info on what month they are working in now.
We also faxed and mailed an additional hardship documents to Vienna and they were received and attached to our case.

All it said, do you waiver as best as you can, every little paper counts and you should win your case.

If you will post an outline of your hardship it would be easier to answer your question. For example, we did not have kids, both of my husband’s parents died long time ago, he was working as a PC technician. We were writing about family ties, work, economical, financial, medical hardships.
We won.

Good luck
