View Full Version : Petition for alien relative 'son of us citizen' (I-130)

Hello! Everyone, Iīve reading this forum for a while yet and it seems really helpful. Thatīs why Iīve chosen to sign up and post my own thread.
My issue is the following: My father sent the I-130 petition in the ends of february and we still havenīt got a response from the USCIS at all.
We only know that the check has been cashed but.. thatīs about it.
Can anyone help me?
Iīd be grateful if you could post experiences about similar situations (father/mother-son/daughter) so I can know a bit more about this, and also If you know any helpful number where my dad can call to get more info on the status of my visa or on how to procede... please

P.S: by the way Iīve just turned 18 if thatīs of any help. Iīm living in Argentina and my dad is in California, he is a US citizen.

Hi Argentinian,first of all, welcome to the site! :wave: Second, i suggest you start preparing yourself to be patient when it comes to USCIS.. :D About your case, you really cant contact USCIS if you dont have a receipt # for them to look up... but since your check was cashed, im assuming, you should be receiving a Notice of Action anytime soon...
Anyway, to introduce myself to you, we may have a different case, but I was also petioned by my mother, a lawful permanent resident in 1997... and would you believe it or not my priority # just came out this May...2008!!! BAsically, im adjusting to become a permanent resident only after 11 yrs! but because you are under 21 and your parent is a US citizen, theirs nothing to worry abt.. All it takes is patience...

As far as the check is concerned, i'm a bit worried cause it was cashed like two months ago... i should've received a notice of action already, shouldnt i?

Not to make you worried.. But yes... You should have received a letter already saying that they rcvd such amt... But anyway, what paperwork/forms were sent? only for application to petition a relative (i-130),right?

it's not you who should receive the receipt notice of the petition (NOA1) and the approval notice(NOA2)... it should be the petitioner, in this case your father... ask him if he received anything from USCIS... once his I-130 petition is approved, that's when USCIS forwards the petition to NVC and that's when NVC starts sending the beneficiary(you) communication...i sent I-130 petition for my mom in the philippines on feb 21, 2008... i received NOA1 on march 3, 2008 and NOA2 on may 13,2008....your father should have received something by now....

Hi angel_eyes. Yes, i know that my father (the petitioner) is the one who should receive the NOA but he hasn't received anything at all..
that's why im worried, and now i'm even more worried cause he filed more or less 5 days before you did... soo.. thats kind of strange...
where did u send your application?

i sent the I 30 to the vermont service center via usps registered mail... my petition is now with nvc..yesterday, i received the aos fee bill... if he hasn't received anything at all, i suggest he call uscis... maybe they sent him something...at least he shoud receive noa1 after his check was cashed...

but with him not knowing the receipt number, it may be hard to get any info from uscis... i guess it's worth a try calling.... or maybe they just sent the noa1 late... maybe it's on it's way to your father...

I'm wondering what are the steps to follow now... my father hasn't got a response yet... he sent copies of the application he sent in february, in late march...and still nothing..
but the check has been cashed.. there should be someway to solve this issuee :S

Ok!! So something WAS going wrong after all...
After many attempts of calling to the USCIS and talking to a machine, my father got to talk to a real person to ask about my application's situation. The woman told him that she was going to find out about my situation and he gave him a number to call her.
Today my dad called, and the woman said there was no check attached to my application. That's weird cause the check has already been cashed.
So my father has to send a copy of the check and a certificate that it's been cashed to the woman, and then we can go on.
I'm happy to know something about my application. I hope that this woman helps us to make things ok and fast.

Does he have a copy of the cashed check? Usually the bank has record of this. For example, I was able to view the back and front of my cleared check online. On the back, USCIS should have stamped your case number. It can be hard to figure out, but if you can decipher it, you can use that number to track your case online or ideally get more info about your case.

thanks Guerra! However, my father called the lady yesterday and she told him that everything's good now and that my visa is being processed so he should be receiving a mail in the upcoming days!!!

OK, so now how long do I have to wait til my application is approved?
I'm looking at the processing times in USCIS.GOV and they're just in JAN 17 2008 for my visa.. will this take long?

Yaaaaaaaaaaaaaaaaaaaaaaaaay! My father received the notice of approval! It says they're gonna contact me from the US embassy in Argentina :D..

My dad received the AOS letter and I received the ACL here in Argentina.. things are speeding up.. I sent the ACL back on monday and my father's sending the AOS this week I hope... :D.. WILL I BE IN THE USA IN JANUARY?
