Hey all,

How do you file a motion to reopen/reconsider??

Trying to do it without the assistance of an attorney.

Any takers? The whole process is a mystery to me....

This has been an emotional roller coaster for me and I need help fast!

we've been at this nonsense for over 7 years, so take the bull by the horns and do it yourself. most lawyers (laurel excluded, of course:) :wave:) have no clue.

btw, hubby had cimt and failure to obtain police records (his mom couldn't get even...public record? and uscis then didn't get them when they said they would), so they are hedging on something with us. i'm sure you won't deal with this-surely don't want to discourage you!

i think our biggest problem was, with our first lawyer (who stole our money and to this day is wanted by the fbi for tax evasion), we tried to follow thru with letters but got no response...now that there's infopass, keep on top of it. remind them that you are still waiting!

yes, i'm also in the same situation. just got the denial 2 weeks now. i practically have no 'extremes' for my hsl. i just went ahead did it on my own from tips gathered here just to get things rolling & was also hoping to benefit from any new immigration bill that didn't happen. now, i really don't know what to do, with no strong arguments to make an appeal. please enlighten me people.

I filed a motion with the help of my congressman. I live in California. They were very helpful with me and I read a while back that the motions get put in the backlog. We were denied in December and we filed the first week of January. I am keeping my fingers crossed that they will get to January soon, we have been apart for 2 years now. You can also email the consulate and ask for a new appointment- see the memos from Laurel Scott where she posted procedures for denied waivers. You can do both.
About not having any hardships, really think about it, what if they were not able to come back in. Health, schooling for your child, do you have any ailments, even if they are small now but can become a problem? Family history of high blood pressure??? Heart conditions, high cholesterol? Look at Laurel Scott's memo on writing hardship letter. Good luck and don't give up!

Came across your post. If I were able to do a hardship letter for my husband, could that include....
being a high risk-pregnancy??
I have kidney disease, and although not in immediate distress, if I were to become pregnant, the perinatologist would keep an eye on me as a high-risk OB. Would that not be considered extreme hardship??

most definitely and though your kidney disease isn't that bad at the moment you never know if or when it could get worse and you can write about that too. Think worse case scenario. EXTREME is the key word.

Thank u for the encouragement. But after searching around it seems I am better off refiling coz I can't put in add'l hardships to an appeal, just add'l evidences - that's what I gathered around. I thought it would have been easier now with the denial letter coz I thought it is just countering it item per item. The hardest part is that I have to go through the manila embassy.
