I was wondering if anyone could tell me what to do with one question of the form I-485 (application to register permanent residence) it asks:
"Have you ever been deported from the United States, or removed from the United States at government expense,
excluded within the past year, or are you now in exclusion, deportation, removal or recission proceedings?"

I am not sure if i should say yes, bc i was once sent back from Miami`s airport. I did the whole waiver process with a approval granted.I am scared my GC could be denied if i check yes for this question. Whats the right thing to do? :shy:Thanks guys :)

not really sure about this, but was you given a deportation notice, or any official notice of any kind. How long ago was this, was you denied entry because of the visa you had at the time, had you been to US on multiple occassion during that year? (tourist visa I think you can only stay 3 months in 1 year). maybe some else can comment on this, but it pays to be honest, as Immigration may find out, I think I would write a statement and attach it to I-485.

Thats my thoughts, maybe someone else can better advise.

Thanks for your reply Jake. I was thinking to attach the letter sayin i got my waiver approved along with the I485 submition as you advised. I had a tourist visa when i overstayed in 2000 and i never got any deportation letter or anything. I was sent back to my country from the airport due to my previous overtsay..So, i'm not sure if they classify it as deportation. Well, if anyone could give any other insights!!!!Thanksssssssss alot

Eve, you were never deported. When you tried to enter POE they turned you around. You went back at your own expense. They allowed you to withdraw your petition for entry. You never entered officially. You were not allowed to enter.

"Have you ever been deported from the United States, or removed from the United States at government expense,
excluded within the past year, or are you now in exclusion, deportation, removal or recission proceedings?"

The answer to the question is no.

Thanks Pink Pig for correcting me, I wasnt too sure about this, thats why I asked if she was given any official letter or deportation notice, I haven't gone thru this myself, so I didnt really know how to answer. Learning something new everyday LOL.

No problem, Jake. That is the strength of this site...many folks giving different opinions in an open forum where we can discuss and evaluate the information, thereby giving the questioner the best chance at the correct answer.

Thats what I love about this forum, everyone is friendly, and going thru or have been thru similiar situations, I have been on a few other forums, and some people can be very nasty and unhelpful, on some of those forums they are telling people that if their partner has EWI'd that there is no hope for them, I always suggest to that person to come take a look here, where they wont have nasty remarks made to them, but given good sound advise and support.

I know that (those) other sites well. They never fail to amaze me with the depth of their nastiness.

hmmm they are very comical reading, I must admit, I post there, usually in defense of someone, when I first posted there, a few of them were real mean to me, but I just let it go over my head, and posted some cheesy remark back, like I said, that forum is not that good for advise.

Thanks a lot for the help once again. I took forver to come back bc as i recently moved my life is upside down and my internet is just not helping either. I'm still working on all my papers to be submitted !!! I AMvery happy to count on the friends i made here!!! Luckly, i never went to those websites that you guys mentioned....;)

Doesn't the waiver you completed pretty much pardon the offense?
