I live in croatia with our USC child and my fiancee that is from croatia, but my husband is banned for five years. I tried to live with my husband and his parents but, it just does not work out. I want to go home to the US but, my fiancee cannot, i know that the 601 is available for him but, would it be easier to get married in croatia or to go back to the US and apply for a fiancee visa. It is extreme hardship for me as a USC to live here in croatia

Welcome fran - Whether he is your spouse or your fiance, you can go through the process and file the I-601 for him. Your waiver would be processed in Vienna.
If you aren't married, it's probably faster to file as fiances, but you don't have to return to the U.S. if you don't want.
There is a guide in my signature that should help you with the process.
BTW - why is he banned for five years?

But if they are two seperate people than you will have to get a divorce from your husband before you can file anything for your fiancee.
