View Full Version : New to site, info on Ex. hardship waiting period

I am new to the site and dont know the short terms for things. Also what is the pilot program in Jaurez?

We went to our interview in Feb 2008, found out we had to file a 601. I still dont understand why we had to file this. My husband was here on a travel visa when we got married (11/2006) and came to visit us often (us meaning our daughter and I). He was sent back at the border when attempting to cross. 1st officer stated suspision because he was driving one of my cars. Have paperwork on 2nd officer but on first (first officer states he didnt say he was married or actually said he denied he was married, but paperwork from 2nd officer talks about him stating married to us citizen and has child) Visa was cancelled (he signed cancellation papers) and hasnt been able to cross since May 30, 2007.

March was our 601 interview... Lack of sufficient extreme hardship evidence... had 30 days to submit. Wish I knew then what I know now! Finally hired a laywer and submitted by April 22, 2008. So now what... how long will we have to wait? How can I track my case? Can I call and cry? What can I do besides pray for him to come back?

I am sorry to hear that trink Actually people who are back logg they have ti wait about to 10 months or more to get aproved. The big mistake of your husband is that he overstay his visa so that is why he needs the waiver, Make sure you send of the evidences about the harship you will suffering with out him.

Actually, it doesn't sound like he overstayed, but rather the office is claiming some kind of fraud because of getting married on a tourist visa and subsequently crossing back and forth. If you've already submitted a waiver, then all you can do is wait. :(

Where is your husband from? Wait times vary between countries.

I'm sorry! Like gaby said he will need to wait for his approval in mexico. You can send more additional evidence to support your waiver. Best wishes.

He didn't oversstay his visa... he traveled back and forth. They stated fraud... beacuse the 1st officer put in the computer that my husband denied being married... which he did not do. Funny how you get a copy of everything but doesnt state that.

So now I know what we are called... backlogged! At least I know what it is called.

So you are 100% that the fraud part was taken off the computer system? That would play a big part if you send more evidence. I would make sure you tough base on that very well. Also to help you figure out what date you start from its when DHS has received your waiver. So if you had the waiver apt in March you might have been in DHS system as of the end of March or begining of April. That is when you start waiting from.

Maybe he was (or they suspected he was) living in the U.S. essentially on that visa, and just crossing back and forth to not overstay? Because that is a misuse of a tourist visa.

The most important thing you can do right now is make sure you read about the I-601 waiver and be certain that what you and your attorney put together is a very strong case for why you will suffer extreme hardship if he is barred from the U.S.

There are a lot of resources on this forum to help with that. You can't really call and cry. They receive up to 1000 waivers a month in CDJ. You just have to wait and be sure that your packet was strong.
