I finally got a response from CDJ to the e-mail we have been sending but they sited the wrong sections of the law:

Dear Madam,

Your husband was found ineligible for an immigrant visa under Immigration and Nationality Act sections 212(a)(9)(C)(i)(II), Unlawful presence in the United States and 212(a)(9)(C)(i)(I), illegal re-entry after prior immigration violations, not because of the time accumulated in the united states.



Under the latter ineligibility, he is barred from entering the United States for ten years and has no recourse for a waiver of ineligibility for the duration of this period. He cannot apply for permission for entry until after.

According the what my sister said that was checked-off the the white sheet of paper the Consular officer gave her husband those are not the write INA sections! I've been trying to get a hold of her to confirm that the codes on marked on his sheet were INA212(a)(9)(b)(II) and INA 212(a)(9)(c)(I).

ce&ll - where did you send the email? Have you gotten a Senator involved? I think you need some elected official assistance, especially if they are quoting the wrong INA sections.

I e-mailed cdjimmigrantvisas@state.gov, I'm just waiting for her call back. Do you think Laurel can help????

I just sent my sister the forms to fill out for the Senators I sent them with a relative that left to Mexico last night and I told her to fill them out and to go the city and have them faxed! Now I will have her do it ASAP especially with their response. I will have her fax me the sheet given to my BIL at his interview and send another fax to CDJ with that sheet attached explaining their mistake!

I think you definitely need a consult with Laurel, especially because she has alternate email addresses to contact the right people. The people who answer emails at the address you sent to only respond with what they are told to respond with -- they are like a call center and often have little accurate information.

For the privacy form for the Senator, it would be much faster if your sister just fills it out and emails it to you.

She faxed me the sheet that BIL received at his interview:

The boxes checked were seccion:

212(a)(9)(B)(II)-la cual prohibe expedir una visa a cualquire extranjero que haya estado ilegalmente en los Estados Unidos por un anos o mas.

and

212(a)(9)(C)(I)

The e-mail from CDJ gives 212(a)(9)(C)(i)(ll) and
212(a)(9)(C)(i)(l). I will be checking on Laurel's chat tomorrow and set-up a consulation with her if she's available this week. I don't know if the laws they gave in the e-mail are provisions under 212(a)(9)(C)(I). We were trying to clear up that the 212(a)(9)(B)(II) he was not here more than 1 year prior to the last entry and now this!

This is really bad.... I'm so sorry that your sis and hubby are going through this.... Do you think maybe he was found ineligible because he came in ewi more than once although he did stay less than the 180 days all together??

I hope Laurel can help.... She will have an answer.

I would absolutely do what the others have suggested and speak with Laurel. I don't think this is the right type of situation to try and handle on your own. Hopefully something can get resolved and soon!!!!

Hi, I had posted @ one time that I went rounds with CDJ back in Feb. They were answering me with wrong information, sorry I just don't think they check, I finally asked to get information with an intellegent answer, they did answer and went step by step to make sure it was my husbands case.

Thanks pinkpig! I have already spoken w/Laurel today and she will be helping us to try and figure out this mess. I have faith in her and God willing we get positive results.

We all know Laurel has a repoir with Warren Janssen and hopefully she can get this HUGE ERROR straightened out for you all?:thumbup:

She is an excellent Atty., and there is no doubt that this CO who interviewed your Brother has his law all messed up in interpreting what is right and wrong? Keep the faith and hopefully it will all work out good!!!!:D

I spoke with Laurel yesterday afternoon and now I'm waiting for the contract to sign. We are limited on what we can do but we can't give up at this point. At this point we must try everything, God-willing this will all get straightened out. I hope for the best! We will never know if we don't try therefore I have made the decision to continue this fight!
