We got our approval letter!!! I am so excited...(and in shock) it's finally over!

Our I-601 was denied in April and we decided to file MTR and we have been blessed with a miracle.

For anyone still waiting...Don't give up hope!!!

Thanks for all the help and advice everyone has given me!!

Rope's waiver was denied. I want to say their first interview was between January and March of 2006, that was a crazy three-month period. All those waivers were sent to DHS in March 2006 - Lots of waivers - it took forever for them to approve/deny them all. Rope waited a long time, 13+ months, and was then denied.

It's great to hear the MTR was reviewed that "quickly." I'm sure it doesn't seem quick to them, but sometimes it seems like appeals and efforts to get cases re-opened take forever, so this is great news!

That gives me hope!!!! I filed a MTR in January of 2007 after our I 601 was denied in December of 06 after a year wait. Congratulations and can you tell me more about your case!!!

That is awsome!! Congradulations, I am sure you were not expecting that! For those who are waiting for the appeal, can you give the basis for the MTR?

It is important for many to know that the MTR is different from the actual appeal. MTR are decided by the DHS that originally denied the waiver. Appeals are decided by an office in the US. MTR have to have been an error on the part of the DHS office that did the adjudicating. For example they did not use all the evidence supplied to adjudicate the waiver (like extra info was mailed in and never joined with the orginal file).

Our original waiver HSL was poorly written, and I don’t think it had enough evidence to back it up…
So from what I understand…(I hope this is correct) we were able to file the MTR based on new evidence and events that had happened during the year we were waiting for approval…
We were facing foreclosure on our home and had to sell, we had a vehicle repossessed…etc
During that time I was also seeing 2 therapists ( I had never had to have counseling before)…All of these things were not part of the original HSL
So we had tons of new evidence to supply. I am sure there is more to it though

We originally filed the waiver in January 2006, and our DHS date was March 2006, and we were denied March 2007

Warren was the one who signed my approval...and I believe he handles all of the MTRs...I remember reading that in one of Laurel's chats.

MTR are dealt with by the officer in charge of the DHS office that does the adjudicating. In CDJ that is Warren Janssen. MTR are only approved if there was an error on the part of the adjudicator (for example they did not use all the evidence to adjudicate the waiver or there was an error in the interpretation of the law). In rope's case, she said it was for additional hardships that arose during the wait time (it would be interesting to know if she had submitted evidence for this during the wait time) I think Laurel mentioned that most MTR are denied. Once it is denied then it goes to the appeals office in the US. If it is approved, then they go for visa pick-up!

You are right, I went back to read some of the old posts. I filed an MTR in January and it is still in CDJ. About four weeks before they denied my case I had sent in additional information and it was not viewed when the case was decided. My congressman's office helped me with the MTR. I am really hoping to hear something soon! This whole process is inhumane, nobody should be seperated from their loved ones ever!!! Hopefully all of our cases will be resolved soon!!!
