View Full Version : Persuing K3 and CR1 both.. switching?

I made a new thread of this in case anyone hasn't seen this because it's kinda shocking they are doing this again..
So they are letting me apparently persue both my K3 and CR1 visa at the same time.. I want to know when the last time was that anyone "switched" - getting the immigrant visa at the K3 interview - and whether or not they will still do this .. I wanted to ask Laurel at the next chat but until then does anyone else know.. or any advice.. I'm kinda confused and stressed out about what to do .. if I should try getting it at the K3 interview or just wait to be assigned a CR1 interview..

i cant give u advice sorry. i just wanna let u know im in the same situation. im now on the k3 track, hoping to be able to switch to cr1 at one point... good luck to both of us! :)

tasks - I am not sure this has been done recently - and really I think I only recall one or two cases of it happening in the past.
Here is what I remember about it ... before the pilot program - if you went to your K3 interview and filed the waiver - but at the same time continued your I-130 track, IF your paperwork for the I130 made it to the consulate before you waiver was approved (since it used to take 12 months or so for both the waiver approvals and the I130 interviews to be scheduled) then you were able to switch.
However, now that K3 interivews take only a few months to get scheduled - and NVC takes a few months (plus the wait then for your interview in CDJ) in my opinion, it is unlikely that your I130 paperwork would catch up to your K3- allowing you to switch.
So - should you go to your K3 and get approved through the pilot program - unless your case is complete at NVC and already sent to the consulate you will not be able to try and switch at that point - since the process is not complete.
Does that make sense?!? Maybe someone else will have a diff opinion - but like I said, I have only seen one or two cases switch successfully and I believe they were pre-pilot program.

And my opinion - if you are not concerned about doing AOS back in the US - I would stick with the K3 if that interview comes before you finish with NVC.
If - god forbid - you get backlogged at that point - then I would see the possiblity of you picking up a CR1 visa once you do get an approval though and not worry at that point, since you will be done with NVC then for sure.

according to what we have read on the forums, you'll pursue whichever process is approved first, if your 129F is approved then you finish the process and the system will automatically dropped your 130 and viceversa, but once again, rumor has it( on this forums) that Vermont and even California are "cancelling" 129F's so there is no choice other than going after the 130 route. If this is not accurate pls correct me

Yeah that was the rumor but apparently CSC never cancelled my I-129f .. argh I HATE not knowing what's going to happen .. so they could still force one or the other on me possibly ? Like if I get a K3 interview they aren't going to let me continue processing the I-130?

THat's not quite my question.. I've already HAD both approved and been allowed to pursue both paths simulatenously.. then last night my husband brought up something.. he said I don't want to be given the K3 interview and not go thinking that we'll get one for the CR1 .. but then we never do and we have to wait more .. Does anyone forsee this happening did they ever stop one or force a decision or can I just both go simultaneously as I think mach12 did..

When you get your interview/ appointment info by mail, it will state which one the interview is for and give instructions (which will differ slightly.) I understand your dimelma but don't worry about getting a letter & not know which interview it is for, it will be very clearly stated.
Also, re your PM< I have some of that stuff in a box, I'll scare it up and the rest I'll need to get from my sister. But I didn't forget about you and I'll do it this week!

Oh I know they will let me know which one its for I'm just wondering will I get one for each or just for the K3 since it's first ?? I get quesy not knowing what will happen

I think they are canceling I 129f at the csc. My wife had her I 129F and I 130 approved on the same day. One the I 130 has a nvs case number as of today.

They did not cancel mine I am already about to get an appointment for it I want to know if I will still get one for my I-130.. I guess I will just see

So when you got your ds3032 and fee bill it was for a cr2 not the k3 even though that was the one that was sent to cdj.

As far as I know.. (I was all but out for 9 months when we were in MExico) but I was the last one to have the interviews "switched" We were pre-pilot program and all the new rules so I don't think it really pertains to your case. AND our CR1 and K-3 got to CDJ within about a month of each other. Our K-3 appt took a little bit longer to get compared to the girls that didn't have their I130 there already, but seeing what they went through to get AOS it was well worth the extra month or two.
If I were you I would work like crazy (I know you are) to get all the paperwork in for the I130. If you do get a K-3 appt in the meantime email, mail, fax them to cancel that appt and get another one. Than maybe by the time you get another one your I130 will be complete and there is more of a possibility they would "switch"
But again I understand your dilemna.. it's so hard because things can change in this game so quickly. We actually asked my husbands boss if she thought we should go for our interview early (like the K-3 timeline) or go later. She said the earlier the better just because they could get in trouble for hiring him as an illegal. So we went early, had we waited we would have gotten to be part of the pilot program. Looking back I don't regret it just frustrating.. It's so hard to know what tomorrow brings especially with immigration so I say you do what your gut instinct tells you to.... that's the best way! ((Everyone told me not to go to Mexico with my husband, I just "knew" everything would be all right.... and it was)) Good Luck in your choice!
