Reason for Inadmissibility

my hubby ewi in 1998, and has never been back to mexico.

He has a misdemeaner disorderly conduct ticket on his record, but my lawyer said I should not put that becuase it is not grounds for inadmissability becuase it is a petty offense.

any thoughts?

Well, his reason for being inadmissible is his unlawful presence in the US, but I don't know how that gets worded on the I-601...

You can write "unlawful presence."

So where do I put the informationon his misdemeaner?

That would have went on his DS-230. If you forgot to put it,just send an updated form with hubby to his interview. I am not sure if you have to provide the record of the incident or not.

I put Section 212(a)(9)(B)(II) which prohibits visa issuance to any alien who was unlawfully present in the United States for one year or more.

Not sure about the misdemeanor!

I put the misdemeaner on the DS230, but he was never arrested, just given a ticket to pay.

if you still have a copy of the ticket, copy that.
