View Full Version : I-129 & I-130 Denied >.<

Today I finally received a letter stating we were denied because the petitions were filed susequently.
The letter also states there is no appeal to this decision, however, it says I can reopen with by sending in a fee of $588 .
I am not sure what I need to do now...any advice would be extremely helpful. I am now in seek of a new lawyer, as I just threw 2k away for this to happen. :(

What did your lawyer say about this?
I am not 100% on the I-130 lately, but I believe they changed the rules in the last year allowing the I-130 and I-129F (for K3) to be filed concurrently. They used to require you to include the receipt notice for the I-130 with the filing for the I-129F, but when the fees changed that was changed also.
It sounds like it may be a USCIS error, not your lawyers, but hopefully someone who recently did that part of the process will add their insight soon.

At the USCIS.gov site it states this about the I-129.
Filing Fee :
$455. There is no fee for petitions for K-3 status based on an immigrant petition filed by the same U.S. citizen.
Does that mean if I paid the I-130 fee then I don't have to pay for the I-129 since we are doing the k3?
