My I-130 is still not approved, I am getting very impatient. The last update I have was on 5-7-08 which is when I beleive they received my RFE.
Has anyone sent in a recent RFE and since been approved?
Any other ideas?
Help!

Has the wait time for I-130s sped up? Mine took 6 months to be approved.
I'd say you just have to be patient?

Wow you filed right about the same time I did.
I'm with the CSC and I would have been approved right about April 23, but I recieved an RFE and thats why its been delayed. I am so bummed because I have been without my husband since November......its tough. :(

Hang in there...RFE's seem to take a few weeks to get everything processed. I bet you'll have your approval very shortly! :)

But why did you get a RFE?
I received an RFE because I only send in the judgement and not the entire 16 page divorce decree which included my agreement. The judgment was not signed by the judge and referred to the last page of the agreement. Dumb mistake on my part...........Actually we relied on the paralegal who has 15 years experience..........:(

Well... I think I will be waiting here for the long run. My husband is in removal proceedings.. and those usually take longer to process... ughhh.. We have been waiting close to three months already.. our I-130 is currently @ VSC.. I hate it :(

I've been "only" waiting for 2 1/2 months, but it feels longer than that. Plus, I have everything ready for NVC (tax forms, bc, passport, etc etc) what makes it worse to just wait!
perez782
05-15-2008, 11:06 PM
Chalakita, why did you mailed your to Chicago and not CA? They take a longer time!
chalakita
05-15-2008, 11:26 PM
Perez- When I read the instructions it says "send the form to Chicago" I guess all the applications have to go there first, I think its a new rule. Pls dont tell me it takes longer, I am thinking 6-months for my approval, isnt that long enough? :(
You almost done with the NVC Woohoo! You should be in CDJ soon! Good Luck :)

You know what I was shock when I got approve in four months. I have notice that they are taking long to approve in other places. I can't wait to be done with this whole process. Good Luck to you too!

Angie, my husband is here with me. He hasen't seen his mother for about 14 years. That's really long and sad. I'm really lucky that my case is moving along. I just can't wait to be done with this process. Your approval should be on it's way. Have faith! Good Luck with everything.

Wow.....14 years that is amazing, sad for him of course. My husband had not seen his mom for about 5 years because she came to see him in 2003, but he left in November because she was ill. He was so afraid to leave...she died 2 months later so I am happy that he spent those 2 months with her. Thanks and good luck to you! I am very happy about your progress. This is wonderful!

I'm so sorry that your away from him. It's hard! Do you have kids? I know I'm getting close to go to CDJ, but I'm starting to panic and sad because I don't want him to get backlog. My hubby has a clean record, no problem with INS or police. But still I know that we need to be prepare for both situation. Angie, stay strong everything will work out.

Yes, I have 2 kids but from a previous marriage. We do not have kids together. He left shortly after we got married and I am afraid to get pregnant without him being here to support me. My husband has a mistemeanor (sp?) of wreckless driving (he popped a wheely on his motorcycle) He never new it would be a mistemeanor (sp?) he thought the worse that would happen was that he would get a ticket. I am very worried about that. I'm sure you will be fine. We have a wonderful support group here. Have you started your HSL? Thanks for your support...:)!!

No, I haven't started yet. This week was my last week of school. So I will start working on it. See I'm turn 26 this year and I can't wait to have a baby with Hubby, but I know that we have to wait because it will be hard without him and like you said not being here for the support. = ( Try not to worry. Did he get a ticket, have you check his record? I know we have a great support group here, I'm so happy that I join this site.

He got fined, went to court, paid his fees and they closed the case. No community work. He took care of it, but you never know. Yeah, I am happy too. Thanks again and keep me posted. Can I add you to my buddy list?

Are you serious?? Is it in Spanish? I sent my husbands in and it is in Spanish but I only recieved an RFE for my divorce decree........I really hope I dont get another one for something else.
Does anyone know if they send out one RFE for everything that they need or is there a possibility that they will send out another RFE at a later date?? I am now confused.....

we never even sent his birth cert with our packet, so our lawyer could not understand why either, they dont ask for the beneficiaries so why do they need it translated

It's not a dumb question, I understand many people around here do not understand what it is.. .
Our I-130 was rejected because it was the beginning of 2008 and the dork of ME had to put 2007 on our check!! So it came back to us.. luckily it was just that lol...
Removal proceedings are the same as deportation proceedings. My husband was falsely accused, ended up arrested and then immigration got ahold of him... we are fighting the deportation proceedings with an AOS through the courts..

J3nni, Your attorney should of mailed that off with the first packet. Also, we never got it translated. I don't think it's required because your going thru CDJ. When we first file, Our attorney mailed by hubby BC and my marriage certificated copies only.
jsierra1982
05-16-2008, 03:45 PM
that is ridiculous. they shouldn't be sending RFEs for the beneficiary's BC because IT'S NOT IN THE INSTRUCTIONS THAT IT'S REQUIRED!!!!!!!!! i've checked many times unless they've changed it in the past week or so...AND i didn't sent my husband's with mine and we got approved, as have many others. it is not right to send RFEs for something that's not in the instructions. BUT, i guess since people have gotten an RFE for it, i guess that people should include a translated BC for the beneficiary just to be on the safe side. better safe than sorry.
perez782
05-16-2008, 03:59 PM
Jsierra, why are they asking to be translated if they are in spanish, I mean we are going to CDJ, why do they required it? I think it BS!! for them to give out RFE!!
jsierra1982
05-16-2008, 05:17 PM
you don't have to translate it AT cdj. you have to translate stuff that gets mailed to a USCIS office in the US. at least i'm pretty sure. but in CDJ all the evidence you submit with the HSL has to be translated.

Today, I received an e-mail that they received my RFE and that they would notify me withing 60 days of their decision. I cannot beleive it can take up to 60 days. I sent my RFE certified and they actually recieved it on 5-5-08.....what is the HOLD UP???? I am so frustrated...........sorry, I needed to vent.
Diana, thanks for the explanation. Best of Luck to you both. You are in my thoughts and prayers

Three months...geesh...sorry to say but more than likely you have got a lot more waiting to do. My husband is also in removal proceedings and our I-30 was received at VSC on 11/21/07 and we still have not heard a thing. The only touches we received were back in February 2008 and they must have been minor because we never received an email or letter requesting or stating anything.
I am just bummed with the whole process. In three more days it will officially be 6 months. I am not sure what we are supposed to do than. I have heard you have to wait an additional 30 days before you start making phone calls.

Not sure if this was answered yet in this thread but being in removal proceedings does not mean that your I-130 was denied. You can file an I-130 while in removal proceedings.

JennyM, can I bang heads with you? Does USCIS realize how bad this whole process messes with people's lives and emotional/mental well being? I had to back off for a while because it was getting me depressed.
Simply put, whatever happens, happens. Put it into God's hands (or whatever higher power you believe in) and try to relax. You cannot control these things, and when things happen you will deal with it at that time. I found myself worrying about "maybes" and "what ifs" in the FUTURE that I had no control over. I was forgetting about living life in the moment and treasuring what I have now. If they do not approve my husband and he has to go back to the Dominican Republic, than I guess I will be packing my bags. It is not the desired outcome, but I will try to make the best of it.
