Hi, thanks all of you for you infos. I am very glad that this site exists, and you ppl make it better. Here is my story in breif.
My dad married a USC when i was 9, and i moved to Houston when i was 10 years old in 1997. In 2003 my dad and my step mom (USC) got devorced, while our green cards were still in the process of completing. I went to middle school, high school and College in Houston. i have 1 more year before i graduate. In Feb. 22, 2008, my dad, my little brother and me were picked up by immigration at home. Immigration told us that my dad didn't show up to court for his green card hearing, therefore a warrent was issued from the Immigration Judge back in 2004 for our deportation. My dad told me that he didn't know there was a court date. Anyway, while we were in detention, we hired a lawyer and she told me that i can stay and file for AOS if i marry my gf. I asked my gf, which we met as a freashment in college, and she said yes. To be sure, the lawyer wanted to see our records before she files a motion to reopen our cases which were closed back in '04. She ordered the files from the immigration office. For 2 weeks, they still hadn't got to her. She said tomorrow she will go to the immigration office and just read them there and then file for motions to reopen, that was a Wednsday. On thursday morning, 2:15 a.m, two INS officers came for us, so we were deported. The lawyer filed the motion to reopen our case the same morning 9:48 a.m. Thursday morning, and my brother and my dad's cases were reopened. She hasn't heard anything for my case. The IJ ask the US govt. to bring my brother and dad to court, but the US govt said no and they will appeal his decision. The US govt. filed a motion to reconsider, but the IJ denied it. so now the US govt. is going for an appeal. Anyways i am in China now, illiterate, with no friends, no career prospects and i am without my sweetheart. I am completely lost my direction in life, and i've be depress everyday since i was deported. it has been 5 months now, and is not getting any easier.



So here are my questions, what are the chances that the US govt will win the appeal? what happened if the US govt. lose the appeal? I am doing a fiancee visa with my gf. what are the chances of it getting approved in China? How long do i have to wait?

I have a friend who just did an 129F in Asia. He was approved within 7 months.

Because you were deported and been in the US illegally you would need to file the I601 and I212. (I would think) I don't know how common those get approved. Good luck!

I'm truly sorry about what happened to you. I'm from the Philippines and I have been here for almost a year now. Though I gew up here, I stayed in the US for 16 years, I adapted its culture and it has been pretty hard for me to adjust on the way of life here. BTW, I wasn't deported, mine was voluntary departure cuz my mom passed away. I'm working on my fiancee visa too. I heard it will take like 6 months or less but like they said, you will need to file an I601 waiver as well. Anyways, goodluck to you...

Also, not sure how the US consul in China are but in the Philippines, they're pretty notorious, very strict but there's one member in this forum who recently got approved...I'm keeping my hopes high...it's all i got for now
