I hope I did this right!! If I didnt I'm sorry...
My husband EWI 01/10/1990 at that time he was 16 years old. He has never left the country. He graduated high school and has diploma, has 2 small business, has US citizen 9 year old daughter, no criminal history, no DUI's, minor traffic tickets, he has ill mother with alot of chronic illness. I submitted I-130 on 09/12/2007 and approved on 02/08. We are confused on process. We know we have to send a packet to NVC and pay some fees to NVC. before NVC can mail us packet. What does the NVC packet include? After the NVC packet is submitted, do we wait for appt. (CDJ)? What is the waiver I-601 and can this waiver appt be scheduled before interview? What Visa does he need? confused there are so many visa's. Does anyone know how much the process cost? This whole process is so confusing and overwhelming. We hired a lawyer but unfortnatley not good one. I just dont want my husband to end up in CDJ and not know what to do. This is why I'm asking questions now. I just read on some of forums that there are some people that go to interview and not know what they have to next. We are still deciding if I should go with him or wait here. Its a tuff decision. Especially when your whole life has been here. The thought of going to another country scares me. My son dont speak spanish. We just dont know what to do...HELP PLEASE

I 601 wavier has to be filed after the Visa is denied. Once you have your visa appointment you can schedule your wavier appointment. HAs to be at least 3 days after your visa appointment.

jaden - welcome.

If your I130 was approved 3 months ago - you should be well into your case with NVC now ... have you gotten ANYTHING from them - or has your lawyer??

Typically, it only takes 2-4 weeks for your case to reach NVC and then another 1-3 weeks usually before you see your first forms ... chances are the first forms were sent to your lawyer - and I hate to say it - but if you havent seen anything yet - then perhaps your lawyer is 'sitting' on them.

I would call the NVC's automated number - 603-334-0700 - follow the automated prompts - and find out if they have your case, and if they do - what they have processed for you so far. You will need your case number that is listed on the approval notice from USCIS for the I130 to do this.

Please feel free to ask any more questions you might have.

This all probably seems overwhelming right now - but the sad thing is that many people trust lawyers who don't always have your best interest at heart, if you know what I mean. Take things one step at a time - and continue to educate yourself in this process (just like you are doing!! :)) and things should fall into place!

We havent sent any of the fee's to NVC because, my husband dont have mexican passport. We have heard rumors you need mexican passport. We were given an appt. for passport Oct. 29th. This is why we havent sent fee's to finish process NVC. Thank you all for your help. This site is so helpful, I'm glad not alone.

Congratulations on your approval! What Luckysprite said it true. You do need a Mexican Passport in order for your husband to travel from Mexico to the United States once his visa and waiver are approved. You also need a copy of the biographic page to send in with the forms to NVC so they can verify his passport.

Jaden - you will in fact need a copy of your husbands biographic page in his passport to submit with the DS-230 once that time comes.

That is the last step at NVC though - and if you want to proceed up until that point, with the fees and the other forms - you can. Atleast then, when you get the passport - there will be only one more form to submit.

Has your lawyer indicated that they have any of the forms from NVC yet? You are not to send anything to NVC without them first sending you the packets requesting what they want from you.

For example - they will send you a 'bill' for the affidavit of support form. Once you return the bill with payment, they will generate and send out the packet with the forms. Then the next steps come, etc...

The whole process takes a few months, if you take your time and don't use the shortcuts that many on here use. But getting started now - will put you almost out to Oct. by the time you get the passport and you can proceed then!!

Thank you so much for this information. Our attorney didnt mention any of this info. We will go ahead and proceed with sending fees and etc...

What is HAs?
