View Full Version : Filed I-130 four years ago! What do I bring to app??

I filed an I-130 and it was approved Jan.2003. We did nothing after that because we were hoping for a new immigration bill!!!
After finding this site I decided it is time to move forward and not be afraid anymore. I called INS today and they said their records show our case is still open. He said to make an appointment to talk to someone. I made the appointment for this Friday but I have no clue what to bring. I never went forward with any other paper work and I don't want to show up unprepared. I know I need to bring the approval letter and all of our personal information such as marriage certificate.
I called a non profit and the guy said not to go to the appointment and to hire an attorney. Now I'm afraid this appointment my hurt our chances rather than help them!
I have a packet of paper to fill out from four years ago that might be out dated and I have no clue what would need to be filled out. Can someone help me.

hmm, i don't know...is it an appointment to see if you can go interview in cdj? i'd bring family photos and joint financial records and stuff as well as your marriage certificate in case the validity of your marriage comes up.

That's the problem I don't really know what I am doing! I made the appointment to get more information however I don't want to go down there and have them send us away because we aren't ready for the next step. So I guess my question is, "After the I-130 has been approved what did you do next?" Is there specific forms I should down load before we go?

I do not know how things were processed 4 years ago - but I know that as of right now - when your I130 gets approved - your case gets forwarded to the National Visa Center - and they continue to process your case.
As far as your case being 'open' - I believe that I130's do not expire. However - if your case ever did reach the NVC - and no contact was made with them in a years time then your case with them would have been closed.
I don't know exactly what to tell you to bring - as I guess I am assuming once your I130 is approved - the USCIS does not process your case any further. They simply forward it....
The only thing I would also suggest - I notice your husband is from Mexico - did he EWI? If that is the case, and he entered without inspection - then I would most likely not bring him to the appointment with you. I dont want to say that it is a trap - but things like that have been known to happen. Go alone, if you must - but I guess I too, would atleast consult with an attorney before doing anything at this point. Did your husband EWI? If yes, I think you should be looking into the I-601 Waiver (Mexico) section, as he won't be able to AOS!
But if he had a visa when came in, then he would be able to AOS and the next step would be to file the I-485 packet (which now includes the I-765 for Employment Authorization).
Anyone... correct me if I'm wrong...

after our I-130 was approved they sent us the follow up forms then once everything was paid and processed we got our appointment in CDJ.
Are you just planning on going there and inquiring and hoping they are going to let you file your paperwork?

I think you should probably not go to the appointment, because this will alert them to your husband's illegal status and he could be deported. If he's not here illegally then no worries.
I think you need to call the NVC and ask them to send you the... Visa fee and the I-864 processing fee thingies. Those are what you should have gotten after the I-130 was approved. This should get things rolling for you.

my daughters I130 was approved on 10/4/04 but she has not gone to the embassy as yet now since she wants to go does any one know if the case will be still open and what do i have to do

My husband did enter EWI. So I think I will cancel my appointment and try to get more information. Thanks for the advice. I was going to bring my husband to the appointment but I had a bad feeling about it. I will call and inquire about the Visa fees and I-864 but I guess at this point because I waited so long I should talk to an atorney first. Thanks everyone!

You can consult with Laurel Scott - visacentral.net - you have to pay $100 or $150 first, but she'll be able to put you on the right track, even if you don't end up hiring her for the whole process.
