hello there. have a question. when filing the 130 here would they ask me to have background check, fingerprints, would my order of deportation will show? dont want to trigger deportation. what if do 130 in my country peru do also need fingerprints done?

Fingerprints get done at the visa interview and before for the police certificates for certain countries. For the U.S. you only need a fingerprinted police record if you have criminal arrests or convictions.
They are going to know if you have a deportation order at the interview. . .no question.

hey emtc...do you know by any chance if a traffic-related arrest (no license) counts as a criminal arrest?

I'm sorry, I'm not certain on this one.
I know it wouldn't be a criminal arrest, however, you might still need fingerprints since it will show up on the name check, just so that they can see specifically it was not a CIMT.

My husband had a no license arrest from over 10 years ago when he first came to the US. We had all the records from it just in case, but I don't think they even asked about it at CDJ. He had a 5 year old DUI so he did respond that he had had trouble with the law when questioned. DOn't know if that helps....It seems that traffic violations are not an issue at CDJ

i don't know, though. he was NOT printed at the arrest. he says he has never, ever been printed in the US. i was there when he was arrested and the officer was just like, "you're being arrested now, but because you have been cooperative, your wife can take you home after you sign this paper." we were given a "notice to appear" at the county jail within 5 days of the arrest--we went immediately since we were an hour from home and they didn't print him or anything--they didn't even let us inside!! we just stood in the foyer and a lady gave us papers explaining the right to counsel, etc, and put in a request for a translator at court. well, in last week's chat, laurel said that all i should provide is the arrest record, which i can get at the DMV, and the court disposition.

My husband was stopped and given a ticket for driving without a license. They impounded his car, but just let him go after that. Is that an arrest? Do I have to mention that in the HSL? Yikes I forgot to tell my lawyer about that one.

it's not an arrest unless he was actually told, "you're under arrest." driving without a license is not an arrestable offense in all states, but it is in maryland. a ticket is a ticket; an arrest is an arrest.
