View Full Version : is risky to file 130 if had deportation orden and still in US?

i am new here. i am peruvian, enter on 1992 EWI, have a deportation order since 96, never left the US. i am about to start the whole process 130, 601,, 212. if file 130 here is it risky? would that be a hey! i am here came and get me letter? since we have to give all our info.
that kind of scares me. i see it takes a while to get appt. i wnated to stay out of country the least :confused:amt of time.

you know, i don't really know...i know that under normal circumstances filing an i-130 will not trigger anyone to come get you...but you really have no other choice but to file it ASAP if you want to get that interview.
i say do it. it DOES take a while to get an appt--but if you keep putting it off, it's going to take even longer.

Either way you are going to need the I-212 so in some ways it doesn't really matter. Your other option is to leave the U.S. but then you will definitely be away from your spouse for a long time. I don't think you have anything to lose by filing and waiting in the U.S. I might consult with an attorney though.

You may want to hire a lawyer because of the deportation order. I'm not sure if you will have a problem with USCIS to process because of that order. Your case will be considerably more complicated.
