Sponsoring husbands sibling to come here?

Hubby wants to send his younger sister to America so she can attend American school. How does that work exactly? Does she have to wait for a visa to come available or does she get to bipass that because she's an immediate relative?

she's never been here so there will be no waiver needed.

Can't she go the educational route (ie get a student visa) or is she still in elementary/high school?

i'm not an expert on student visas, BUT that would definitely be the only way to go. if you tried to do family-based, you can't sponsor your husband's relatives, you'd have to wait till he becomes a USC because LPRs can't file for siblings. THEN, the wait for a sibling visa is currently over 7 years at this point. so by the time she got a family-based visa, she'd be way over school age.

I think it's 7 years for siblings under 18. I thought it was 12 for siblings over 18....

Is there a way to get him assigned as her legal guardian? Could he adopt her?

and that wait time is AFTER he gets citizenship, which is another long wait.

Yeah, it's pretty much out of the question for her to be sponsored as a sibling and get here in time to go to school.

If you could adopt her, it's possible.

A student visa would be more likely but I don't think that is really possible until she is college aged.

If you look at the bulletin (http://travel.state.gov/visa/frvi/bulletin/bulletin_4205.html), there isn't a separate category for siblings of different ages, that is only for children.

Even if your husband was a citizen now, the wait to bring a sibling from Mexico is 18 years.

Nothing you can do, unless you adopt them. My husband and I looked for any way to bring my little sisters here, but I could not find a way unless hubby adopt them :(
