Mouse maybe the state has some sort of form the require be filled out? I had a horrible time trying to figure this out for NY. It turns out I just sent it in because I was sick of noone knowing the answers, and it worked out fine...
I don't know, have you tried calling them to ask them about the procedure? They shouldn't deny you...

No sorry...I file with a ITIN for my husband here in Indiana with no issues, but since it is a State Tax refund, perhaps they have a specific state policy (wouldn't surprise me at all with all that we are seeing). Call and ask. Good luck

Some states have laws regarding this that they will not refund with a tax id. The federal government will not allow certain deduction if there is no valid ssn for everyone in the house. So just call again and ask.
Good luck!

Okay this is why.... http://www.boston.com/news/local/massachusetts/articles/2008/02/17/more_illegal_immigrants_are_rushing_to_file_taxes/
KS and MO refuse to payout refunds to those with out SS# which means not only are we not getting the Stimulus we are not getting our 1500 state taxes back.... Im not happy about this... they are making EVERYTHING harder for us.. they dont want illegals here, but they dont want them going back to home lands either, at least not w/o spending some time detained... Im kinda fuming right now

I feel the same way, myhusband is not here he is currently in mexico so I took him off a a dependent and claimed head of household. Like many others I needed the money.
Sorry to hear that, but unfortunately things are upside down now, I hope soon we have something fixed w/ government/immigratin.

I filed for the 2006 state tax in Ohio. Still haven't received our refund. They are wanting me to send in a copy of my hubby's ITIN, letter from employer (which I can't get). One of these days when I have the time and money I am going to drive down to the columbus office and argue with them. When I call the information line, they can't help me because all they can see is that my refund hasn't been approved yet.
I am getting ready to send in my 2007 ohio tax return with a copy of the ITIN hoping that one will get approved. I would think it should, since I was the only one with income.
It seems like we shouldn't live in KS, MO, or OH. :D

I had a big problem last year with the state of Illinois. It took nearly a year to get our refund. I went round and round with them and delays of 3-4 months between correspondence. I filed our fed tax return with my wife's ITIN # electronically and filed our state return by mail with copies of our w-2s which had my wife's invalid SS# on the w-2. The state didn't like it that the return had the ITIN and the W-2 had the SS# that did not match. I ended up refiling with my wife's SS# and then I got the refund. We were worried for quite awhile that they would turn us in to the SSA. About a month ago we finally got the refund with interest.

My hubby has an ITIN and we have had no problem getting federal or state refunds. I am sad though that we won't get the stimulus check. I am a US citizen and so is my son...they should at least give $600 for me and $300 for my son...and they should be glad my husband is trying to do the right thing and file his taxes even though he has no social. :-(
