Has anyone filed and recieved citizenship after having gotten a 601 waiver? I ask b/c my DH is eligible to file in August and we are getting ready to do so- but I am worried about Part 10, Question 26- "Have you EVER been removed, excluded or deported from the US" is being denied a visa/barred 10 years (which was what the waiver was for) considered "exclusion"?

SHould we answer yes or no- considering the rest is straightforward for us- no arrests, etc... I hate to pay all that $$ to an attorney just to fill out a form. Thanks.

P.S. I love this site and so glad to have a reason to come back- I lived here at I2US the entire process of his waiver.

I would think that it means post I-601 but if you check back I'm sure someone can confirm what it means.

I think that the waiver being approved is proof enough that you all are eligible to file the app.

We just sent in the N400 for hubby...his waiver was for CIMT. I included a copy of his waiver approval with the package. Hopefully, all will go smoothly.

ratito921- hey! Ah life has been crazy! I can't believe we are coming up on 3 years! It's been too long- I've been checking I2US everyonce in a while- but with 5 month old twins (and a 5 yr old) life is hectic!

They will have information about his waiver in his file, so i would not omit it from the application. But since his legal residence status was granted based on the waiver being approved, I don't see why the approved waiver would bar him from getting citizenship after meeting the 3 year residence requirement as a spouse of a USC. Of course this is just my layman's opinion, I am not a lawyer.

Hi Jesse!

So did you fill out the app and turn it in? What did you end up writing? Curious as we are eligible to file for citizenship in 2 months. Crazy how joined site in 2004 to begin process and here it is 2008 and are able to wrap it up. Time flies.

we are hoping to mail it off this week (we are trying to get a fee waiver) We are putting YES to that question and then putting an explanation attached. I would rather put YES to something that really should be a NO (with the explanation) than the other way around.
