First of all i want to thank you for this website!
Here is my story ... I came to the states on J1 visa 2.5 years ago-2006. (never have left the states since). Now im 1.5 year illegal here. Also got myself in trouble with driving the car on expired driving licence and never showed up for court..so i guess i have a record..? My american fiance and I want to leave to my country (Czech republic). We are just wondering how long is it gonna take to get me back to states if we leave to czech,get married there and how would that process go, what forms would i have to file. What is your best advice please?

Hi Verca... I don't know if I'm telling you the right thing, but I think the best thing to do is decide if you want to wait a little longer to get married, or if you want to get married sooner. You would file the I-129F if you want to wait until you get the visa to get married. But if you want to get married sooner you'll wait until after you get married and file the I-130. That's the first step... Because you came in on a visa you should only have to do an adjustment of status... I don't know much about how that works... Hopefully someone else will know more.

if you leave the US, you'll get a 10 year bar for overstaying. The best thing for you to do is NOT to leave until you have your green card.

Do you have the 2 year requirement on your J1?

You also need to find out what happened at the court and what exactly they did

ditto, because the arresting officer told my husband that if he didn't show up for traffic court, a bench warrant would be issued for his arrest.

You need to find out if you can adjust status despite your overstay and the J1. If you can, you should marry in the U.S. and not leave the country until you are a resident. If you leave and marry abroad you will have to go through the foreign-filed waiver process which is, to say the least, uncertain.

Thank you for answering.
The J1 visa was issued only for 1year Jan2006-Jan2007. And about the court im looking for lawyer because i dont have any idea where to start.
