Hello my name is Cindy from C.A. I am new to the site and very excited that I found it!! I heard about the I-601 years ago but an attorney told us to wait for a new immigration bill to come up. Well, we all know how that is going. I still have hope, however I am fed up and need a change in our situation. I don't even know where to begin. We were approved for the I-130 years ago and we have just sat on it waiting not really knowing what to do. It says to file and i-485 on the paper but we have not done that and I am wondering if we should? can anyone help give us advice on how to start this process. I still am not 100% sure this is the best approach however I am so tired of living like this. Plus we have a little girl and a new baby on the way. It would be nice to know we have stability for them. This pilot program I have heard a little about sounds hopeful but I am completely lost. Thank God I found you guys!

Welcome Cindy!!! I hope you find all the answers you need here.

I believe that after 1 year if you have not moved forward on the I-130 then you have to re-do it. Sounds like you should just start from scratch and get him started on the road to legalization.

Do you mind me asking a little history? When did your husband EWI and how many times?

Well my husband came EWI at the age of 18 in 1999 he only came once he is almost 26. I think that's what EWI means. We were married in 2002. We field and received the approval in Jan. 03. so it has been a while.
I just checked the immigration and naturalization web site and typed in our receipt number and it said to it was approved and said to follow the instruction on the form. The next step say to file a I-485. I looked it up but couldn't find any background information on it except that is costs about 1,000 dollars.

the I-130 does not expire as long as a marriage has not dissolved. also, since your hubby entered w/o inspection, he cannot adjust status (I-485) in the states since he has no status to adjust from. did you receive additional paperwork after the 130 approval? as ellie said, you need to keep your case open after a year has gone by (this is with the nvc paperwork, i believe) by calling-someone will chime in if that's not right!

Welcome Cindy! Ask your questions in the other threads so that more people will see them and answer them.
I think you should start by calling NVC to ask if your case has been closed and can be re-opened. You may need to re-file the I-130, but call first to find out!

I think that the others are right. You should contact USCIS and find out if your I-130 is still active since you have not proceeded. If not it is not a big deal to re-file. The ugly part is that you will have to pay the fee again. The receipt number will be on the approval of your I-130 that you have.

I believe you can call USCIS at 1-800-375-5283 and provide them some information such as your receipt # and they will be able to let you know if your I-130 is still active.

It is hard to get to a live person on the phone so you may have to play with pushing different numbers until you find the combination to get you to an actual person.

Let us know what they tell you.
