View Full Version : Procedure for submitting spouse children over 21

Hi guys....appreciate any info on this:

I successfully got my wifes waiver approved 2 months ago..thank God...my case went through Peru.

Now my wife wants me to try to bring her children or sisters or even nephews over here as well....

is the process the same as I went through to bring her over here? I130 ect....

somehow she believes it takes about 5 years to bring over her son for instance..

her children are over 21....same question for her other relatives...does the immigration process take about 5 years (if approved at all) or not really that long? I do not see why it would take so long to submitt all documents and get an answer....

Congrats for your wife, but unfortunately she would be the only one you can file for. US citizens or residents can only file for their spouses and stepchildren under 21, if the marriage took place before the stepchildren were 18.

When she gets her GC she will be able to file for her children, but as a residente, it will take about 10 years, she has to become a USC son that she can do an upgrade to the petition and it will take less time.

To petition for her sister she has to be a USC and for her nephews they have to be under 21 at the time of the appointment, which won't be probably, because peticions for siblings take around 12 to 15 years.

Alway remember, the more people you file, you have to take into consideration the affidavit of support, just like you needed to present an affidavit, she will need to present an affidavit of support for every person she files for. you are already taking care of her.

Thanks..ok..I understand then from what you are saying that the best route for her is to become a U.S. CITIZEN first,..then apply for her children....how long if she is a citizen for her children petition to process?

Also there is little or no chance of her petitioning and being approved for any of her relatives over 21 then? even if she is USC...Correct?..

Yes ..thanks pinkpig for having the record...

Actual time from waiver submittal was about 5 months 3 weeks...not bad considering some folks saying 8 months..did it all by the numbers....we had no complications per say..other than the wait..this was consistent with the consulate officer who I spoke with on the phone..not that he was very nice....but my case was well structured and presented....no medical hardship..many other reasons however...and I prayed and trusted God above all...
