Question about EWI suspended & Expired DL

Hey everyone, I was wondering if anyone might have an answer for me. My fiance had a driver license and on the evening of 05/11/07 (one night before the expiration and his b-day) he got into a minor accident. His license was already suspended anyway and he got charged with knowingly driving while license suspended. So I was wondering. He has 7 more days of work release to do and some more fines to pay off. Once we get that taken care of and file I-130 and get a notice in the mail, can't we use that to go get his license back? We are from Florida by the way.

From my experience, when you take the NOA1 into your DMV office, they typically dont know what to do with it, so they will issue him the paper 30 license and send it on to Tallahassee to make the call. If the person at the counter tells you they do not accept it, ask to see something in writing or put up a little bit of a fight. Its not worth the headache for them since they don't make the decision locally anyhow.
