View Full Version : Do I have everything I need for the I-130?

OK here goes.....


1. Table of contents
2. I-130 petition with check attached with click
3. G-325A with passport type photos attached for Wife (USC)
4. G-325A with passport type photos attached for husband (MX Citizen)
5. Photo copy of USC bithcertificate both sides
6. Photo copy of Husbands birthcertificate both sides
7. Photo copy of Marriage License both sides
8. Affidavit of bone fide marriage from biological mother of USC and Friend of USC
9. Photo copies of pictures of the couple

Questions -

1. Do I need to get his Birthcertificate translated into English?
2. Can I send a personal check?
3. Do I really need to send in the photo copies of the pictures at this time?
4. Anything else you all can think of that I will need?

1. We had my husbands BC translated into english, but I believe there has been some 'debate' on whether or not this is actually required.

2. I think a personal check is fine. We sent one, and I know others have too.

3. Pictures would certainly help. I would send them in for sure.

4. Are you sending in 4 copies of each G325? Each one with an original signature, not copied? Umm, what else can I think of? Do you have any other evidence of your marriage being real? Joint bank statements, leases, other bills in both names? Any mail (letters, cards, invitations) that are addressed to both of you? All of those things help proving the relationship.

We didnt have much in terms of evidence, as most things are in my name only - but we did send in copies of our checking and savings acct statment, copy of our 2006 taxes that we filed jointly, and a copy of the declarations of my car insurance. He is listed on my policy - but as a non-driver.

Thanks...Yes I have 4 G-325A signed by me and 4 for him. I think I will translate the birth certificate and get it notarized just in case.

We are going to add him to my account soon, we have had joint insurance for years so I will send in that statement. We didn't file joint tax returns, we will amend my last return when we get his ITIN. I will see what else I can come up with. I hope to have this out next Friday.

Any other suggestions guys?

Guys! is is required to send photocopy of birhcertificate for non us citizen?I was going to send my husbands photocopy of birth certificate since he is us citizen?I dont even have my birthcertificate

I am not sending the Non-US Citizens BC with my packet anymore. I will get it translated for the interview later, but according to what people have said here and on the VJ fourm you do not need it.

I am sending mine next week. I am waiting to get the notarized letter from my mom and friend and my CC and bank statements as proof of a bona fided marriage and then I am sending mine. We may be approved around the same time. Good Luck!!

But I think it would be better to get the letters notarized so that they know the person that signed it is indeed the person who wrote it.

We filed out I-130 petition in Jan 06, and we didn't send half of what you're sending, unless the requirements have changed since then.
This is what we included (which is listed on the intructions for the I-130):
▫ Filing fee ($190 money order)
▫ Forms G-325A (Biographic Information) [Azul y Vampy]
▫ Passport-style photographs [Azul y Vampy]
▫ Marriage certificate
▫ Birth certificate [Azul]

We filed our I-130 in January of this year (was approved in March). This is what we sent:
I-130 Application
G-325A (for both me and Luis....1 each if I'm not mistaken....)
Personal Check for $190
2 passport style photos for each of us.
Copy of Marriage License
Copy of my divorce decree from my previous marriage
Copy of my Birth Certificate
Copy of his Mexican Birth Certificate (not translated)
My mother wrote a short letter asking for speedy approval and to not take Luis from me and my family.
Made a copy of our Electric and Water bill

That was it and in 2 months we got our approval on the I-130.

Azul - I was going to send just that, but I have read that they want proof of stuff linked together. Like checking accounts, apartment leases etc. So I and sending in copies of the joint checking and joint car insurance.

Make copies of everything that you send and keep for your records, you never know. Also keep the receipts for the mailings especially the proof of delivery.

We mailed ours out in March 06, with the same list of documents as Azul y Vampy. It was approved in 3 months. We didn't include anything extra, such as the joint accounts. Of course, we are bringing proof of a bona fide marriage to our visa interview. Anyways, good luck. I'm glad you'll be avoiding the price increase later this month! Wishing you a speedy approval! With all that evidence, they shouldn't have any questions that you are truly married :thumbup: Better safe than sorry...as my mom always says.
