do i need to do the hardship letter to fill with the waiver or i just need the deployment orders of my wife to get approved...

Military deployment? If she has actual orders in hand so much the better. Having gone through CDJ (you are from Mexico?) the wrong way for a deployment I can provide you a better path:
She needs to call "Mr. B." (the name and number, since it shouldn't be used lightly, will be provided) and say her military situation. For the direct line they won't listen to you long, so she should say her introductory words quickly. Something like "I'm a U.S. servicemember with orders to deploy...".
They should be able to mark you down for a very quick appointment. Do you have everything ready? Exactly where are you in the process? Does your wife know of all the contacts at USCIS and the NVC if needed?

i have the appointment on may 16 in ciudad juarez, and thats pretty cool... the thing its she have to leave on june 3 to armory school and then leave june 25 overseas... do we need the hardship letter to file the waiver or just her deployment orders will works as one...

Is May 16th your first appointment - or your waiver appointment?
The deployment orders need to act as evidence in her hardship letter.
Have you familiarized yourself with the I-601 and its accompanying documents in order to have is successfully approved?
She needs to write a letter indicating what extreme hardship she would suffer if your visa is not granted on the day of the waiver appointment. The letter needs to be supported by a lot of evidence - and her deployment letter would be such evidence.
If you get a chance - read through the approved HSL's posted at the top of the forum to get a better understanding of how one should be written.

oh men...
may 16 its my first appointment, finally...
well... we start doing the hardship letter but it is hard to do it, we dont have kids no body is sick like everybody write its just her, her sister, her mom, thats it... what would be a good points to put on it...

You need a complete waiver packet. Your wife's deployment order can be the strongest hardship but you can't just submit that - I mean, you can, but no one would recommend that. You should put together a letter with evidence of that and any other extreme hardships on her behalf.

Her deployment/career in the military is an excellent argument and definately should be listed first in the letter. She can focus on what she has accomplished/trained for in the military and how she would be affected if she had to relocate to Mexico, what she would be losing if she had to 'leave the military' (which she probably can't just do, right?!) or how her life/career would be affected without you here ...
I think at this point though - you need to call and schedule the waiver appointment.
can you provide a little more details on your case so we can help you better? Are you sure you will even need to file the I-601. Are you currently in the US - did you come here with or without a visa, how many times have you entered and do you have any sort of criminal history??
If you entered without inspection - you will in fact need to file the I-601/letter/evidence packet. But this is not done at your first interview. *yikes* and currently they are scheduling waiver appointments for July. I am not sure if you will be able to expedite an appointment due to her upcoming deployment - but I would definately try to.

well...
because i am EWI i know i need the waiver, and now im in mexico because irving tx police pull me over and took me to jail for no driver license and take me to immigration and put me back to mexico signing a form saying i voluntary departure from the country, even we have the 130 pending with immigration.
so i be waiting for almost 9 months in mexico for this and now i hear shes being deployed i dont have a lot of days to spend with her...
about the appointment with the waiver, can i expedite the appointment too ?

I am not sure if you can expedite that appointment.
I would hope that you could - given the circumstances, but I am not certain.
I hope someone else can offer some input on this. I am not sure if you can just contact the consulate in order to do this, as the appointments are scheduled through a call center and not through the consulate directly.
Otherwise - I would call right away for your appointment - like I mentioned, right now they are being scheduled for the middle of July ... well after your wife is due to be deployed overseas.

I don't know if you can expedite the appointment. You guys need to call right away tomorrow. Most likely they are going to schedule you an appointment in mid to late July at this point so she should try to explain the situation and see if they will make it earlier.

so, maybe when shes gone already i can have an appointment for the waiver... when i have the appointment can i expedite the waiver to be revised and see if can be approve or not..? can be expedited if she was already gone ?

When you go to your waiver appointment - they will either approve it that same day - or refer it to the backlog if they don't feel it is clearly approvable. This is why she needs to work on making a strong HSL as soon as possible.
If you are referred - you are given 30 days to submit additional evidence (in order to make the packet stronger) and at that point - you could try to expedite the case. Right now it is taking anywhere from 7-16 months to get an approval, without an expedite.
There is the chance you will be approved the day that you have your waiver appointment though - if you are not approved - then you can try to expedite the case.

The deployment is an extremely strong hardship, but you can't rely completely on it. You need to put a packet together, and if you don't have a criminal record or deportation or any other complication you are likely to be approved at the waiver appointment.
Have you red any of the other example letters on this site?

There have been a lot of members who do not have any children or major health problems that have been approved.
Your wife's military career and pending deployment is a significant hardship to build on.
Go back to one of Laurafern's posts and read the link to her hardship letter. She does not have children or major health problems and used her career/education as well as other hardships to make her letter.
Yes - there is a chance you will be approved the same day you file the waiver. It is not guaranteed ... but this site can help you 'boost' the chances so to speak.
If you want to - and several people do it - have your wife start writing her letter and post it here for others to review. They will go over it and tell you how to make it stronger, better.
It can definately be done!

Deployment and life threatening illness are the two legitimate reasons for an expedite. You need to contact the USC's US Senator and US Congressman to ask for their help with an expedite.

It's unlikely that it will take one year but yes, if you in the military you may be eligible for an expedite. I would suggest contacting your US senator visa their online privacy release form - fill it out with the appropriate information and request their assistance in obtaining an expedite. Fax it their office and call to follow up - get the name/email and direct phone number of the person assigned to your case and stay on top of them.

hey eloko i just went threw all this my husband is in the navy and what he got was letters from his CO saying that they will get deploy and stuff like that..cause in real life they dont have orders for deployment...

eloko - calling the consulate - or the call center will likely answer your questions on if you can get an 'expedited' appointment.
If your appt is not expedited, occasionally cancelled appointments open up, so you may be able to get one sooner than July - there are just no certainties in that. You may have to call frequently to see if a cancellation has occured - but that is another potential avenue to get a sooner appointment.

yes call the number to get a waiver appoiment as soon cause they do take a while..in my case i was also in mexico for 6 months and i just kept calling untill i got it a week apart..

Any or all or none at all can be expedited. We had a member who got all of hers expedited by a US Congressman, because she had very sick children.

Actually a call to Mr. B's number (they will try to field you to the call center, but persist) should be able to schedule an appointment immediately. I was offered an appointment the next day on one occasion that they said they wanted to see deployment orders (in the end my unit had not had orders yet, although on a firm schedule to deploy). The other occasion I was offered an appointment soon after the first we could get the medical appointments done (we took a faxed appointment letter to the clinic).
Of course these were regular IV visas without need for I-601s...

Eloko, I really think you should just try to call the consualte directly and set up an appointment for the waiver that way. Actually, it will have to be your wife that calls since she is the one being deployed. The number to the consualte is: (656) 611-3000 (if your wife is in the US, she will have to dial the 01152 first since they are located in Mexico. Once she calls, she should ask to be transferred to Mr Santiago Burciaga's office.
If they ask for an explanation, she should say that you have an upcoming appointment on May 16th and that you are now aware that you will need an I-601 appointment. However, they are currently being scheduled 2-3 months out at the 900#, but her deployment is scheduled for the beginning of June. The only way she can get an earlier appointment is directly through the consualte.
Good Luck! Try to have your wife call as soon as possible. The longer you wait, the harder it will be to get an early appointment.

whenever i go to the interview i need to tell them my wife its going to be deployed and like that maybe i get my interview for waiver the same day...
somebody happen the same thing or similar...

Now, make sure you have your hardship letter and evidence with oyu when you go the interview AND, make sur eoyu bring proof of the deployment (like a letter from your wife's boss or something).

my interview for IR1 visa its may 16.... and i going to be on cd juarez by may 12 hopefully with everything i need to show them... and dont be in delays... or at least with quick response from them...

eloko - that is great news. I am hopeful that they will be able to look at your waiver the same day you go in May.
